You might think that students at any university would be thrilled to have a Supreme Court Justice — any Supreme Court Justice — on board as an adjunct law professor, and maybe that would be true in a sane world, but while America in 2022 can be called many things, “sane” is not high on the list. Inflation is mostly to blame for Biden’s catastrophic approval rating, of course. But I think what Axelrod describes here is an underrated reason for flagging left-wing support. It’s not (just) that his policies aren’t progressive enough. It’s the sense that he doesn’t “fight,” to borrow a term from righty populists. And when he does make a gesture towards fighting, like when he endorsed creating an exception to the filibuster for abortion rights, he’s destined to end up losing that fight. I wasted 20 years of my life chasing utopian energy. Utopian energy is an imagined form of energy that’s abundant, reliable, inexpensive, and also clean, renewable, and life-sustaining. But utopian energy is as much a fantasy as a utopian society. Seeking the fount of perfect energy allows us to pretend there aren’t real-world tradeoffs between, say, banning fossil fuels and helping people in impoverished nations or between using solar and wind power and conserving natural habitats. For years, I chased utopian energy. I promoted solar, wind, and energy efficiency because I felt like I was protecting the environment.

A judge blocked a Kentucky law which instituted a near total ban on abortion in the state Thursday. The judge’s decision makes Kentucky the third state, after Texas and Louisiana, to have a trigger law blocked following the Supreme Court’s Friday decision in Dobbs v. Jackson Women’s Health Center. After the Supreme Court overturned the 1973 ruling in Roe v. Wade, the abortion issue has been returned to the states, allowing many states to reinstate bans previously nullified by Roe.

The reality is that this nation has effectively split into two countries which are, for the moment, tenuously living side-by-side.
