DENVER — A Denver woman said she has been left with an unexpected mess after she sold her van to an undocumented migrant.
She learned the new owner of her vehicle can’t register the van or insure it in his name. Kamelah Miller was looking to do some renovations on her home. So, her friend recommended someone who could do the work at a reasonable price. “Shortly after that, he was telling me he was looking to buy a car and I was looking to sell mine,” Miller said. Miller gave him a price on her Volkswagen Routan and he

We live in a litigious society. If that car is involved in a serious accident, maybe the victims could sue the seller for damages.

Kamelah Miller said she considered allowing the illegal to register and insure the car in her name. That is reassuring she decided to not commit two forms of fraud.

FYI, in Texas there is a form you can file with the DMV that states you sold your car to "Insert Name+Address of Buyer." You are then absolved of responsibility. It is their car to follow the law with.
It is not infrequent that buyers don't transfer title to their own name- eg, dealers just leave the title in the seller's name until they have a buyer.
I would always file that form. My son sold a car and title was never changed. Many toll charges were incurred by the new untitled owner. Why should a crook change title?
If she had not sold the car to the illegal, Joke Bidet's justice department would have crucified her.

Omg, there are too many golden quotes in this article to pull out. This woman and her 200 commenters on her problem are EXACTLY why Denver is in the situation it is. The stupidity of her woke compassion is beyond understanding.

When you dismantle Society one piece at a time, sometimes things that you hadn't considered occur.
The first thing that occurs to me is did that 'contractor' have liability insurance .. pay workers comp .. withold or pay any taxes.. get a permit if necessary.
In the last few weeks, the traffic at Home Depot (the busiest one in my city and certainly full of illegals) has been signifcantly less hispanic. Could be the weather, or maybe something else. I'm just sayin

The once-great city of Denver has been turned into a shitehole by Democrats - and you just KNOW that the idiot in this article voted for every last one of them, every time.
If she tried to insure this vehicle, any future claim would be denied - she no longer has an insurable interest in the car, so the policy would be null and void. If she tried to register the car in her name, she'd have to have proof of ownership - but she already signed over the title. How stupid is she? Let me count the ways....

I doubt I've sold three guns in the last 20 years, but if I ever do the buyer will speak with a down home country accent or its no sale.
Thanks OP, for the car heads up though.

Many decades ago, a friend's sister bought a car from a man. She told him that she would turn in the plates for him. Big lie! She drove the car unregistered, uninsured but it had the former owners plates.

It should be a crime to sell a car to an illegal alien, and a crime for them to possess it, and a crime to register it, and a crime to DRIVE it.

If you sell your car to anybody, illegal alien or not, make sure you get the title transferred to the buyer immediately. Don't just sign the title on the back and expect the buyer to follow through. Until that title is legally transferred, you could be liable for anything done in that car....new buyer gets drunk and kills somebody. The new buyer has no assets so guess who the lawyer reptiles are going to go after? The title holder which could still be you.

The DMV said: “If the seller signed the vehicle title over to the buyer then they are no longer liable for the car. "
Period. Full stop. It's the buyer's problem.

In some states, until the vehicle is registered in the new owner's name, the old owner is liable. In some states, like AZ, you can go online and file that you have sold your vehicle and the name of the new owner - this does not transfer title, but absolves the seller of liability. I know here in Iowa, it is not unusual for the seller to take the buyer to the DMV to transfer title to protect themselves (I don't know if it is necessary these days, but some old-timers still do it).

Obviously Denver/Colorado just needs to change the laws so not-yet-documented immigrants can register cars and have insurance.
And vote.

In effect he was asking her to commit insurance fraud. When the insurance company uncovered what she did, chances are she would have a hard time getting insurance in the future.

#18 - that's true if the buyer actually goes through with transferring title. It is a matter of proof - if the buyer racks up several hundred dollars in toll fees and never goes down to the title transfer office (here its in the County Court House) and transfers title (because they didn't want to pay the sales tax) then as far as the toll folks are concerned, you still own it and owe the fees as far as the toll trolls are concerned. How are you going to prove you sold the car? Do what #7 recommended. That saved me those toll fees when the buyer of my car didn't transfer title - I had filed the affidavit with the DMV and could prove to the toll trolls I didn't own the car. Better yet, go with them to your local tax office (the County usually has several places in the county where you can do the transfer and pay the tax) and do the transfer of title and they pay the sales tax THERE and then you are protected, because title is now in their name!

Apologize for the second post, but several years ago we traded a Jeep in for a new one at a dealer...about a year lateer we got a bill from a tow service in a city a 100 miles away. The car was towed for illegal parking...they tracked us down by the vin number...of course, we didn't have to pay, but the new owner obviously never transferred the title and afaik was running on temp tags, or false tags...I always make sure I get the plates when I sell a car to anyone...

Good people of Colorado:
1. Stop smoking/ingesting a narcotic with a certain THC molecule that you legalized a few years ago. It's rotting your collective brains.
2. Don't do business with illegal aliens. Period. Stop calling them 'undocumented immigrants' as well. Call a spade a spade, Alliyah Sims.
3. Cut out this 'sanctuary city' BS. Otherwise the Cloward-Pliven theory takes effect (as Denver will attest now.).

In Washington I believe there is something right on the title, you fill it out, tear it off, send it in and the car is no longer your problem. It's not up to the buyer to transfer. Our son sold a truck and I 'encouraged' him to get the title changed right away. And sure enough a few years later, he got a bill from some tow company in California that had towed the car that had been abandoned on the shoulder of a freeway and the tires removed. He sent them a photo copy of the transfer and we never heard from them again.
