Michigan Court of Claims Judge Elizabeth Gleicher ruled the state’s 1931 law that bans abortion, triggered by the U.S. Supreme Court overturning the landmark 1973 Roe v. Wade decision, is unconstitutional.
Gleicher said the law violates the Michigan Constitution’s Due Process and Equal Protection Clauses.
“Despite that men play [a] necessary role in the procreative process, the law deprives only women of their ability to thrive as contributing participants in [the] world outside the home and as parents of wanted children," Gleicher wrote.

What about Equal Protection for the unborn? What about its chances to survive/thrive in a world it's Creator sent it to? Are these judges dense and stupid or just evil?

Her argument asserts that any law that is specific to one gender but not the other is a violation of the equal protection clause of the constitution. Her logic is mistaken because only women can become pregnant so any law that involves pregnancy can only apply to women and not men by nature. The concept of equal protection is irrelevant to this specific law because the condition of pregnancy and termination of pregnancy is not equal between men and women.

Nice try #3 but your well stated rationale and logic has been replaced. We’ve modernized since such things were true. Which also means the judge gets it wrong too.

Actually, the judge is wrong because everyone now knows men can get pregnant, too. Just ask any public school child. So the law applies equally to both imaginary, non-existent sexes.

So if the Supreme Court, the highest court in the land, makes a ruling, a lower court can say no thanks? I don’t understand.

#8 The Supreme court deals with the United States Constitution. This dealt with the State of Michigan constitution.

But I bet they're fine with that law that makes raping a woman illegal.

The judge has it wrong about the law only having an effect on women. The law bans a woman from getting an abortion, that's true. If the judges removes that law, the power is given back to the woman to get an abortion, but there is potential damage to the man (father) who may not want his child aborted. If you use the judges logic, the law should be upheld since it effect both the mother and the father. The law provides equal protection to both sexes.

dangerous argument since it raises the topic of parents being or not being required to support their children and having or not having a voice in whether those children are born. take her logic a little way further and men too should be entitled to economically thrive as they so will, and make choices about it.

Re: #9 - State constitutions and state laws must comport with the U.S. Constitution as stated in Article 4, paragraph 2, known as the Supremacy Clause, which establishes that the U. S. Constitution takes precedence over state laws and state constitutions.

Since when do men have any say in the matter? This decision may open a can of worms she didn't intend to open.
