A judge on Monday barred the Trump administration from revoking Medicaid funding for Planned Parenthood, partially freezing a provision of the One Big Beautiful Bill Act just days after President Trump signed it into law. The temporary restraining order by U.S. District Judge Indira Talwani lasts 14 days and directs the Department of Health and Human Services to "take all steps necessary to ensure that Medicaid funding continues to be disbursed" to Planned Parenthood. The ruling, which came after a lawsuit from Planned Parenthood, doesn't apply to any other health care providers. The lawsuit takes aim at a portion of Mr. Trump's signature domestic policy bill that would cut off

Channeling Andrew Jackson, the appropriate response from the Executive Branch -- after refusing to follow the judge's order -- should be: "The judge has issued an order to restore funding. Let him do so from his own wallet."

If the funding in question had previously been authorized and appropriated by Congress for FY 25, and if it has already been obligated by the administration, then the judge might be within the law in forcing current year funding to be expended as obligated, but only in the District over which the judge presides. If the new law cuts off any previously appropriated funding, then Trump has no lawful source of funding to ensure that the abortion mill is flush with taxpayer dollars. If funding were to be moved from another Program, Project, or Activity (PPA), the president or the DHHS administrator, would be in violation of the Anti-deficiency act. If the judge is trying to ensure funding for FY 26 and beyond, then the law must be deemed unconstitutional and withstand further Circuit and/or Supreme Court review. I don't think judges have judicial 'line-item-veto' powers by invalidating a particular section with which they may disagree. If a law is ruled unconstitutional, then it is not a law that can be enforced. Shoddy journalism these days routinely lacks basic information, like when the provisions within the law are set to commence, (e.g., October 1, the start of a new FY or immediately upon being signed into law by the president) so it is hard to determine the "color of money," a shorthand term for categories of budget appropriations from the Defense contracting world that applies to other departments, in this case associated with the Planned Parenthood abortion funding being terminated, thus whether or not a federal judge can force the payments.

The Trump administration can move forward with plans to fire tens of thousands of workers across the federal government, the Supreme Court ruled Tuesday. A judge in California had blocked the layoffs, finding that they would likely violate federal law. But the justices granted an emergency appeal from the administration seeking permission to enforce a Feb. 11 executive order that instructed agencies to carry out dramatic “reductions in force.” In an apparent 8-1 ruling, the high court said it was not assessing the legality of any particular agency’s layoff plans, nor any moves taken so far to implement those plans.
