Earlier today, Joe Biden announced he was signing an executive order creating a “bipartisan” commission to explore ‘reforming’ the Supreme Court. As we explained, the commission would be looking at all kinds of possible revisions to the Court, including court packing. The commission would consider “the length of service and turnover of justices on the Court; the membership and size of the Court; and the Court’s case selection, rules, and practices.” In other words, Biden and the Democrats would look at all kinds of things they could do to politicize the one branch of government which was explicitly created not to be political. Is Race Discrimination Legal, Or Not? replies

We live in a world in which race discrimination is ubiquitous. Universities, government agencies and all major employers systematically discriminate in favor of some races, and against others, under the banner of “affirmative action.” This has been going on for 50 years. And yet, the 14th Amendment’s guarantee of equal protection has been applied to ban race discrimination by public entities in a number of contexts. Similarly, the Civil Rights Act purports to bar race discrimination in employment and public accommodations. Such discrimination in employment is nevertheless pretty much universal; see, e.g., United Airlines’ recent declaration of its intent to discriminate

Many conservatives are pushing back hard against a series of executive orders on firearms that the Biden administration announced on Wednesday. I don’t doubt that Biden would ban or severely limit private gun ownership if he could, but what is striking about these specific orders is how trivial they are. Biden frames his actions in terms of gun violence being a “public health epidemic.” He refers to the recent Boulder and Atlanta shootings, and says that “cities across the country are in the midst of a historic spike in homicides….” Ironically, that is true. But why? Not because of any lack of firearms laws and regulations, which are legion.
