New York - A federal appeals court on Thursday upheld a New York public nuisance law exposing the gun industry to possible civil lawsuits when people use their products in shootings and other crimes.The 2nd U.S. Circuit Court of Appeals in Manhattan rejected a challenge to the law by the National Shooting Sports Foundation trade group and 14 members including Beretta, Glock, Sig Sauer, Smith & Wesson and Sturm, Ruger. Signed by Democratic Governor Andrew Cuomo in July 2021, the law lets New York, local officials and the public sue manufacturers, wholesalers and dealers for endangering people's safety and health through sales of firearms and ammunition.

Can't stand. Manufacturers are free from prosecution if their product isn't defective and used in a lawful manor. Just the NY judicial trying to score points.system
"The Protection of Lawful Commerce in Arms Act (PLCAA) is a U.S law, passed in 2005, that protects firearms manufacturers and dealers from being held liable when crimes have been committed with their products."

Exactly #6, this has been a law for almost 20 years and the ant-gun crowd has been very angry about it, desperate to find a way around it.
This NY statute is illegal based on federal law.

Time for ALL gun/ammunition manufacturers and distributors to announce they will abandon NY State, refuse to participate/facilitate sales there, including to Police/Govt forces.(who the same plaintiffs and courts claim regularly misuse firearms and massive lawsuits/compensation then results). There is zero reason to have a plant, factory, warehouse, or distribution/service facility in any location which abhors your product.

And,#6, that law was pushed through not by the gun lobby but by the courts themselves. It was a response to a push by the antigen lobby to use the courts to obtain " gun control" by bankrupting the gun industry. Thousands of these frivolous suits were filed and not a Single one was successful. So many were filed that court systems were spending millions just throwing them out and criminal cases were being held up due to the loss of resources.
The courts wanted relief from these useless lawsuits. Boom the commerce in firearms act

Will the NY Legislature now come up with laws going after vehicle, knife, drug, and utility companies? After all, their products have all had a hand in deaths all across the state using the reasoning behind the gun ruling. What about road builders? Should they be held responsible for car crashes? How about the road engineers who designed the roads? Taken to it's logical conclusion, this ruling could extend to anyone or any company who had any hand in designing or manufacturing anything that leads to any death.
