The order, which followed an hour-long hearing, included a seven-day stay to allow for appeal. The judge’s decision puts the birthright citizenship issue on a fast track to return to the Supreme Court. Rule 23 requires notification of rights to not participate in the class action to al potential members. This class injunction is so broad that it includes future unborn. As the mandate in 33 cannot be satisfied, the class action is invalid

Joseph Normand Laplante July 10, 2025 "U.S. District Judge Joseph Laplante certified a challenge on Thursday by the American Civil Liberties Union as a class action lawsuit and granted a preliminary injunction." "The lawsuit, which was filed last month in New Hampshire was brought on behalf of pregnant immigrants, two immigrant parents and their infants." Didn't the Supreme Court just say that district judges CANNOT issue nationwide injunctions. That the district court rulings are confined to those judges' districts. So, who died and made him king? Inquiring minds want to know.

pssst...newborns, and yet to BE born have no standing, cannot communicate their grievance, nor their support, do not have the knowledge or capability to make an informed decision, nor give informed consent. IF they did, the lawsuits against Planned Parenthood would be a Class action of MILLIONS of unborn children...cruel and unusually terminated from their lives. The main "Plaintiff" in this case has spent decades and $Millions of dollars as well as thousands of hours arguing that unborn, and even living children from failed abortions have ZERO standing before any court, they argued that children could and should be given abortions, and that children that HAD been given abortions against their will had no standing to protest after the fact..

If the ACLU can win a lawsuit claiming rights of the unborn then it would be easy to start a new class action lawsuit that would prevent abortions. Hats off to the ACLU!

These hyper-liberal lower court Judges can't seem to be capable of reading plain English coming down to THEM from our highest court. I would hope that our Supreme Court would put forth nationwide a "warrant" calling on ANY judge, who wishes to defy their rulings, to put his/her name on paper and submit it prior to issuing their 'political decrees.' Subsequent to that submission, the Chief Justice could forthrightly, and with all due process, FIRE said Judge(s).

A class action lawsuit typically requires a larger group of plaintiffs to be certified as a "class" under U.S. federal law . Rule 23 also requires that the class must be "so numerous that joinder of all members is impracticable." 5 or 6 people doesn't meet that.

How does this issue provide "standing" before the court for every "single child around the country"? How do the unborn have standing? Those already born here have citizenship and are not "injured" by the EO. The courts have used "lack of standing" to avoid having to deal with so many issues, but it appears that the criteria is stretched extremely thin in this case.

National approval ratings are not irrelevant, of course, but they don't actually tell you what political geeks need to know to gauge potential election outcomes. Political players in Washington, though, care much more about what their specific constituents think, not what the vast number of voters in coastal cities do. We all know that Trump's approval numbers in New York City, Washington, Boston, Los Angeles, San Francisco, and Chicago will be in the toilet.
