An agent with the Bureau of Alcohol, Tobacco, and Firearms has filed a federal lawsuit accusing two Columbus police officers of using excessive force against him while he was working in his official capacity.
James Burk, a 16-year veteran of the ATF, went to a house in the 3300 block of Edgebrook Drive near Dublin to take a shotgun from someone who allegedly wasn’t allowed to have a gun, even do it wasn’t confirmed by the police if the man wasn’t allowed to have a gun !
Nothing else was reported about the ATF agent’s mission.
When you purchase more than one pistol, you have to fill out a multiple purchase form for the ATF. Doesn't apply to rifles, only pistols. By filling out this form, you basically allow the ATF to confirm all of the pistols are in your possession as this is a way to “combat straw purchases”

Never trust a fed though nowadays maybe not any police officer. Did the agent have a warrant? If not or if he did not present it along with credentials - eat shite.

The ATF guy was clearly resisting arrest and looked like a bum, not a cop.
He should be charged with resisting a lawful order.
As an aside, the ATF agent was previously arrested for shoplifting $200 worth of wine. So I bet he's an alcoholic, to boot.

Wow. I watched the video.
Good thing the officers have their body cams because the AFT guy's story doesn't much mesh with the video.
This ATF jerk really is impressed with himself. He is NOT dressed professionally, not in any kind of a uniform, no badge visible, and absolutely refused to cooperate, including fighting them while they tried to cuff him. How is the person who's home he is visiting to know who he is?
INSISTING that they had to stop everything and check his pocket for his ID first. That's not how this sort of a thing works. The police will judge how much consideration you deserve by how you act. He acted like an arrogant jerk, or someone about to do something bad, NOT like a cooperative person and he continued to make things worse.
And then his "I have a medical condition" story. Should have thought of that before you made it as hard as you did, jerk.
This is how AFT agents treat police....imagine how pleasant and helpful they are to the average citizen.

"I've got a medical condition"
Please wait"
"I'm hyperventilating"
I'll take "Things officers hear every day when they arrest someone" for $500.
Do as you're told, jackboot. Things go much easier.

"I'm a Federal Agent"
Then ACT like one! What the heck is this get down...NO garbage.
If I was confronted, I darn sure would do what was needed to continue my business. A cops 1st rule is to go home after his shift. I have zero intention of causing a serving officer to violate that rule.
You, dweeb, need a refresher. Sorry to 20yr vets had to schools you but you were the problem. Was that excessive force? Even in my eyes, not a chance. You brought every part of that on yourself.
Welcome to the US today.

Michelle, I would be more inclined to read your article if you had used simple correct English grammar in your headline. Where are the editors?

Look up “Ruby Ridge” if you want a good look at what fed agents think they can get away with.

Law enforcement people from different agencies usually coordinate their activities, when on other police agency's turf, precisely top avoid this sort of mess.

I wonder if this is the same ATF agent James Burk who was arrested in 2015 for stealing wine.

Saw this the other day. Very odd that an ATF agent is going by himself to the house of a person suspected of committing a Federal weapons violation. I suspect there's much more behind this than meets the eye.

We don’t know what really happened, but you have to wonder why the ATF Special Agent was at the scene alone to confront a person who he knew was armed with a firearm? Usually in a situation like that the lone federal Special Agent would identify himself and seek assistance from local law enforcement before going to the person’s home. Chances are if what happened with local police having restrained a federal Special Agent in handcuffs while he was performing federal law enforcement duties the relevant US Attorney would usually have the entire matter removed to the jurisdiction of the Federal Courts for resolution.

I knew a federal agent in the 80's back when they were at least on the surface respectable. We were discussing the idea that was floating around at the time of shutting down the ATF entirely, and farming their agents out to other agencies. He said it wont work. He said ATF agents are considered bottom feeders by every other agency and nobody wants them.

There was also a story out there within the past 10 days or so that some ATF agents were putting together an illegal list of people with firearms. This is getting downright serious. Glad the cops came, and I don't care if you are ATF dude, you have to obey the law. You are not above it even though you think you are.

I showed the video to a retired police officer friend. He laughed at the idiot ATF jerk. He said that he should have had an ATF jacket, or a badge pinned on prominently, or at least on a chain around his neck. And he should have realized that the way this was going to get sorted out was that he was going to get cuffed, and THEN it was going to get sorted out.
He said that he thought that the ATF guy was too arrogant to submit to "some damned local cops", and his stupid arrogance cost him.
Another "do you know who I am?!" moment from another arrogant ass. When we heard the clicking at the end, we broke out laughing out loud, knowing exactly what that clicking noise is.....the taser. Damned fool pushed until he got tased, too. First class horse's hind end.

Just like someone who'd come to your house to confiscate your weapons. When he's approached by law enforcement, he resists. But, you do that with him and see what it gets you. When they put him on the ground, suddenly his credentials are in his left pocket. He probably has that mental disease called leftism.

Why the Federal agent was there in the first place? So if you try to “work around” the requirement they'll get you. For example, if you purchase Gun 1 and Store 1 and Gun 2 at Store 2, they might be able to see that you had two background checks on the same day.
