By now we are getting used to lower courts misappropriating their roles, acting as if they occupied that of the chief executive. As these cases reach the Supreme Court, they are being overturned, but not without a cost to the president’s agenda or to the respect to which we’d normally accord the judiciary. The notion of a judicial coup is not far off, and people like Elon Musk suggest it’s time for Congress to initiate impeachment proceedings against the worst offenders.

Comments:

Ms Feldman presents the Lisa Cook dispute clearly, which nearly all the mainstream media fail to do, in their rush to narrate the story as one of political vengeance and a power grab by the President. Also, as she has done of late, she broadens her column to review other issues of the week, here Venezuelans and tariffs. Reading her columns is never a waste of time.

These ‘judges’ are left wing hacks and rogues. Their judicial decisions have a dual coordinated purpose. One of course is to slow things down and deduce the time available for implementing Trump’s policies. The other is goad him into violating judicial orders. This then will be used for another Russia, Russia type campaign. The SCOTUS has already shown its displeasure and inclinations. But that is slow and inadequate for what is needed.

The Supreme Court has already ruled on the jurisdiction limits of the district courts. But some still continue to defy that ruling. The remaining problem is that there is no PENALTY for defying the ruling. That should be a pretty straightforward problem for congress to solve. And it could be done in a logical progression that provides reasonable respect for legal ambiguities and judicial process. For example, a first offense could result in an immediate stay and review by the Supreme Court rather than the long delays inherent in follow-up appellate court processes. A second offense could be subject to a multi-year suspension. And a third would be automatic impeachment and permanent removal. This isn't rocket science. Make it so.

The imperial judiciary will continue, because the Republicans, always feckless, chose to adjourn for 5 weeks vacation, so they could come back in Sept to pass an emergency omnibus spending package to avoid a government shutdown, saying they didn't have time for the appropriation process. Yes, Republicans are so overworked that they have not had time to confirm Trump's nominees, and at this rate, Trump's term will expire before they can get that done. As for any reform of the judiciary system, spending sanity, election reform, you can forget about that, as Congress will again be exhausted from all their work, and be taking off Thankgiving until after the New Year, then President's Day coming up, and primaries beginning in February. Nothing will get done next year because that is an election year.

Under our Constitution, Article III judges can be removed from office only through impeachment by the House of Representatives and conviction by the Senate. Although an impeachment vote in the House need be only by simple majority vote, conviction in the Senate requires a two-thirds majority vote. Even Nancy Pelosi understood that any Senate impeachment conviction of Trump in his first term would be improbable, because Trump was a political figure, mere impeachment was calculated to weaken his political clout considerably. Federal judges are, at this point at least, not political figures. Impeachment conviction of an Article III judge in the Senate is highly unlikely to reach the two-thirds majority threshold. The Speaker of the House has enough trouble herding his cats as it is; wasting time on impeachment hearings of individual district or circuit court wayward judges who somehow persist in ignoring recent Supreme Court rulings is a fool's errand, unfortunately. The Speaker of the House is best advised to spend his time doing all he can to insure maintaining the Republican majority through the 2026 election.

Our local judges here make their rulings with wisdom and compassion, just as we would want them to. When they have to put someone away for a long time they are capable of that too. I dont know where these communist activists are coming from. Maybe they should be replaced by the Andy Griffith Justice of the Peace types we have here.

Every one of these leftist, mostly Obama/Clinton appointees, should be put on a List, authored and maintained by the DOJ, with requirement that the Supreme Court is required to review the opinions, motives, and actions of each included Judge in order to determine their fitness for the Federal bench. Also, there should be a Oral Defense Panel held by the Supreme Court in which the District Court Judge is required to answer basic questions regarding their past Opinions (that were overturned by the Supreme Court), Constitution 101, Federal Statutes, and other issues regarding the the courts, American history and the social fabric of the United States. They will ultimately show their biases, anger, prejudices, and ineptitude to sit in judgement of ANYTHING more than a child's interpretive dance competition. The Supreme Court should be REQUIRED to "cull" at least 10% of ALL Federal Judges every year for bad calls, ineptitude, and other offenses before the American people.

Joe Biden graduated near the bottom of his law school class and too frequently nominated his legal peers for judgeships. "Biden judges" compare poorly even to other Democrat judges (see, e.g., Supreme Court justices Elena Kagan and Sonia Sotomayor v. Ketanji Jackson.) It's frustrating that an impeachment-proof U.S. Senate and permissive Supreme Court have licensed their legally shameless obstruction.

The current military conflicts in Eastern Europe and the Middle East will not likely end via negotiated armistice, though Mr. Putin may figure out a face-saving way to cut his losses, while Israel is truly committed to putting an end to Hamas and Hezb’allah once and for all.
