The Department of Health and Humans Services has folded on its demand that Catholic hospitals in Tulsa-based St. Francis Healthcare System extinguish the Eternal Flame candle burning it is chapel. Confronted with a lawsuit that it was doomed to lose over an indefensible position contrary to law, HHS’s Center for Medicare and Medicaid Services agreed to grant a waiver to the bizarre inspection finding that concluded that a single beeswax candle on a wall sconce enclosed in glass constituted a fire hazard to patients.

The Flames of Freedom continue to illuminate America. But they're coming back next month with a CO2 detector and fining the hospital $10,000 per day for indoor pollution violations.

So the muslims can blow their horn five times a day in Minnesota, a call to prayer, but a hospital can't burn a small candle? What's wrong with this picture.

Issue a waiver? That very language suggests the finding was appropriate in the first place. Tantamount to saying 'We'll address that later'.

The hospital and similarly situated hospitals must not let this go with a "waiver", which can presumably be withdrawn. There must be an acknowledgment that the decision was wrong, an apology, and discipline for the people responsible. The guilty must pay a price, and other officials must be shown what will happen to them if they try such foolishness. At a minimum, the court should order the government pay legal expenses of the hospitals, plus damages incurred by the hospital.

In government, there is always some power hunger auditor looking to save the world. They will pick the most miniscule things and make them intlife threatening dangers. As happened with the candle, it was really not an issue and just wasted everyone's time and money.
