By now you know the story of the raid on Donald Trump’s home at Mar-a-Lago in Palm Beach, Fla., but since then, there’s been a pitched debate in the chattering class on TV and the media about Trump’s ability to declassify information. And since he did declassify items, why is it an alleged crime now to possess those documents? I may have the beginnings of an answer.
It’s indisputable that the president may classify and declassify documents. The office of the president has had this authority since World War II. President Obama codified the executive authority to do it in an Executive Order. Even the Washington Post had to admit that.

Raising this possibility, and giving it such careful consideration testifies to the utter depravity of the current regime.
We speak of Trump's, and before him, W's mistakes in office. Surely their greatest was in not pursuing a course of revenge, of "letting bygones be bygones" and believing that good feelings could prevail when a bloody purge was called for. (figuratively speaking here)
If we ever regain control of our country there can be no quarter granted to anyone for any reason.
But here we are, so can this be appealed directly to the supreme court?

An unclassified document cannot be classified because there are an unknown number of copies in existsnce. Documents mus be created as classified so that all copies are thusly labeled.

To charge Trump with a criminal violation of possession of re-classified documents violates the spirit and intent, if not the letter, of the prohibition in Article 1, Section 9 of our Constitution regarding Ex Post Facto laws. Ex Post Facto laws or rules retroactively make criminal, conduct that was not criminal when performed, increases the punishment for crimes already committed, or changes the rules of procedure in force at the time an alleged crime was committed in a way substantially disadvantageous to the accused. Implicit in the prohibition is the notion that individuals can be punished only in accordance with standards of conduct that they might have ascertained before acting. This certainly applies to Trump possessing documents that he, himself declassified.
I tend to agree with #5 on the issue of re-classification of material that when de-classified by a sitting president may have found their way into the public domain after having been lawfully declassified. Re-classification efforts are kind of like putting toothpaste back into the tube. It may be technically feasible but serves no lawful purpose or national security interest. Even if deemed lawful to re-classify that which has been declassified, being in possession of documents that you lawfully held before the re-classification cannot be a crime vis-a-vis the Ex Post Facto doctrine and more importantly, due to the likely opposition of a majority of the American people to a blatantly dirty act by a president whose presidential provenance is suspect, given the extra-legislative changes to various state's voting process, which is clearly unconstitutional but gave Biden the margin of tainted victory.

This whole fiasco is so political, with a Republican President who was the victim of a criminal and political conspiracy and as a result lawfully declassified all the documents found to be relating to that conspiracy. Then following that with a Democrat President coming in, along with his crew that committed the conspiracy in the first place, possibly then reclassifying those same documents and then raiding the Republican President’s home to seize any of the copies of the reclassified documents that he may have, obviously as I said, this fiasco is so political that in the end it must be the US Supreme Court that will legitimately smell it out. In the end the people who took part in a actual conspiracy against the Republican President should be prosecuted under RICO statutes for defrauding the USA and disrupting government operations at the highest levels.

One of the prevailing theories as to why they raided Mar a Lago was to retrieve documents that exposed top ranking officials secretly colluding to use the power of the government to sabotage US elections.
If Biden is reclassified these documents it not only suggests that theory is true but could have given the DOJ the reason they needed for the raid, the excuse to prosecute Trump for being in procession of now classified documents and force him to hand over any copies to bury this evidence for good.
Some might think this is farfetched, but this is the Democrats we are talking about, nothing is off the table and there is no level they won't stoop.

Let's hope there are copies of these documents somewhere. Because if not, the originals will never see the light of day again.

This brings up something that JoeBamaVegetableBiteMe said last year-- that ALL remaining files pertaining to the JFK assassination would be released without redactions.
There were documents that had been previously released without redactions and "in full" that came out in October of 2021 that were released again that had been FURTHER redacted after initial release.
There is no doubt some of those that are to be released will have been "lost" or destroyed as happened by admission of the Secret Service in 1995.
So it is possible that this could happen. We will see if the promise HE MADE to declassify and release the remaining documents is kept and if the actual records without redaction are released.
We ought not to expect much from him except to do the EXACT opposite of what should happen.
