How To Think Like A Liberal Supreme Court Justice

Original Article

Probably you think that the justices sitting on the U.S. Supreme Court must be among the most intelligent people in the country. (snip) Consider Justice Elena Kagan. She was the Dean of the Harvard Law School. (snip) With that in mind, let’s take a closer look at Justice Kagan’s dissent on behalf of the three liberal justices in the case of West Virginia v. EPA (snip) In other words, Justice Kagan has fallen hook, line and sinker for a preposterous end-of-days story of climate doom. She has totally failed to distinguish a kernel of bona fide scientific learning from ridiculous scare stories peddled by charlatans.

Simple, and it has been for decades, if not longer. Pick the result that you want, and have your law clerks dream up an argument in support, no matter how specious and/or unconstitutional.

Kagan was a Dean of a law school, but never practiced law until Barack made her his unqualified Solicitor General. She has never demonstrated brilliance. I was Dean of a School of Business, with substantial Business experience, plus an arbitration practice of three decades. Brilliance is not a prerequisite for the position of Dean - patience, the ability to listen, and to fashion reasonable solutions to [problems are all important. Kagan's writings on the Court are sad, pathetic, inadequate.

She got to be Dean at Harvard for the same reason she now sits on SCOTUS, her gender and race. It had nothing to do with her intelligence. IMO.

They're "outcome oriented" jurists. They pick the solution they want, then find evidence and reasoning to support it, without guiding principles or logic between decisions. It's just sophistry. It's like a detective who wants to pin a wife's murder on the husband. The detective gets blinders on and fits everything into his or her theory and anything that doesn't fit gets rejected.

The justices are supposed to be looking at laws for boundaries within the constitution not scientific p pints. That’s congresses’ job. Perhaps Karan needs a lesson on the role of the judiciary branch of government! Then we the people will decide our representatives are acting appropriately and if not vote them out.

The problem with liberal justices is that that they often want to weigh evidentiary facts in support of or against what they think is enlightened public policy, rather than determine the constitutional powers and limitations of executive and legislative actions vis a vis the rights and duties of the states and the people respectively.

Anyone who thinks America is badly governed right now can comfort themselves that at least we aren’t Britain. (snip) (Boris) Johnson always hated comparisons with Donald Trump (usually based on nothing more than their hair). He was especially stung when Joe Biden made the link. Johnson believed he was different from traditional conservatives. Perhaps he was. And so — urged on by a small circle of advisors including his woke young girlfriend, then wife — he tried to do everything he could to show he wasn’t a conservative. He ignored the UK’s border crisis, pumped money into an unreformed welfare state and raised taxes.
