Race must be considered in determining
legality of police stops and seizures,
WA state Supreme Court rules

Original Article

The Washington state Supreme Court on Thursday ruled that a person’s race, and law enforcement’s long history of discrimination against people of color, should be taken into account when determining the legality of police seizures. The court also clarified state law to say police have seized a person if an objective observer would conclude that the person was not free to leave or refuse a request. But, the court wrote, that “objective observer” must be aware that discrimination and biases “have resulted in disproportionate police contacts, investigative seizures, and uses of force against Black, Indigenous, and other people of color.”

Comments:

A major pro-crime action. In the heat of stopping a crime Washington state police must stop and consider the long history of discrimination by police against people of color.

I guess it doesn't matter that 75% of the crime is committed by a portion of 13% of our population? Have people lost their mind, especially the judiciary?

What if the person is only half black? And some whites can have a dark complexion - especially Greeks and some Italians. The cop with have to do a quick Genetic origins test before turning on the siren.

If I were a police officer I would NEVER EVER pull over ANYONE of color. Let them alone. Never help them or detain them. My father used to say, "how dumb can you be". Between shooting each other and aborting their babies they will soon be extinct. But don't come complaining to me when bad stuff happens. You want to be left alone. So be it.

Two years ago, activist groups went before the Washington state Supreme Court agitating for the release of ALL prisoners over the age of 50 because of the threat of catching Covid. By a vote of 5 to 4 they ruled not to release them. So by ONE VOTE, the Green River Killer, Gary Ridgeway is still in prison. This is a man convicted of murdering over 50 women and authorities believe he is responsible for at least 100 missing women presumed to be dead. Also another monster, David Rice Lewis, who murdered a family of four, the dad, mom and two young boys during a home invasion on Christmas Ever 1985 would have been released. And a law passed last year, Washington state police cannot pursue a car unless a violent felony is involved, impairment, or if the driver is causing a danger to the public. Cops have to get Supervisor approval before engaging in pursuit. Consequently, this year a few thousand people have refused to pull over for traffic violations.

The legal spaghetti and linguistic gymnastics needed to come up with this type of ruling are incomprehensible to most common sense Americans. Bottom line on this case is the man fled from the police after lying about who he was arousing suspicions they might not have had leading to him being convicted of more crimes than those he was already wanted for. Now he is claiming that his rights were violated because of his race? These judges stretch their interpretation of the Constitution to like silly putty to fit their liberal agenda. That they can make such illogical nonsensical rulings with a straight face is ridiculous.

I agree with #5. For many years I worked closely with many municipal police department and county Sheriff's Offices. By far the greatest prejudice and unjustified (brutal) physical attacks were black officers against whites, including weak and defenseless white women who were pulled over because a tail light on their vehicle was out, or an "improper lane change." They also brutalized white college students.

FTA: "The Washington state Supreme Court on Thursday ruled that a person’s race, and law enforcement’s long history of discrimination against people of color, should be taken into account when determining the legality of police seizures." This is asinine. Police are not mind readers. That's why they ask questions. Police cannot do their jobs if a category of subjects get to "flee the interview" based upon guesses that may or may not be accurate about the subject's race, ethnicity, or social history. My home state has become an embarrassment over the years. The lack of stewardship over Seattle and other majestic towns and cities throughout the state shows the depraved nature of the "leadership." There is something wrong with people bent on destroying communities and lifestyles folks used to be proud of.
