Laurence Tribe, a Harvard Law professor and legal ally of President Joe Biden’s administration, has stated that vice presidents do not have the authority to make a tie-breaking vote for a Supreme Court nominee’s approval in the Senate.
News of Justice Stephen Breyer’s intent to retire broke Wednesday, though the 87-year-old has not formally announced the move. The news puts Biden in the position of having to pass a nominee through a 50-50 Senate, raising the question of whether Harris can cast a tie-breaking vote.

It won't matter. No matter who biden nominates, she will fly through because the Republi-Can't will "play nice" and vote for her. Especially the cast of dependable RINO's (Romney, Murkowski, etc).
The Republicans need to play the same type of hard-ball that the Demon-Rats play. His nominee shouldn't get a single Republican vote if she is a lie-beral radical (which is guaranteed). Stall it until we have a RINO-proof majority in the Senate to actually force biden to nominate someone more moderate.

I snicker when I think that Breyer might be upset enough about this "leak" that he won't retire until after the midterms. You can be a liberal justice and still understand that Brandon is a disaster.

Republicans generally allow democrat presidents to nominate who they want, whereas democrats fight like heck on every nominee a Republican president nominates.

Tribe should read the U.S. constitution before he offers bad advice.
The U.S. constitution is crystal clear on the subject of tie votes in the Senate. The VP, as President of the Senate, casts a vote. Period.

Rules? for Dems? They do not follow the rules. Kamala can't break the tie-says who? Dems don't follow the constitution or laws are rules. Check out the border. The judge even said to reinstate the Stay-In-Mexico policy and yet they don't They just keep bringing them over. Everybody knows it is unconstitutional and against the law and nothing is done.

Please recall that Laurence Tribe is the same constitutional scholar who advised Brandon to compel the CDC to re-issue an Order resurrecting the expired and unconstitutional eviction moratorium, which Brandon did in direct defiance of the Supreme Court decision that the CDC has no such authority. For the past 30+ years, Tribe has been as left wing and ideological as they come. If he says no, then I am convinced that there is no wiggle room whatsoever in the Constitution.

You would think that, after the way the demonrats treated Kavanaugh and Barrett, even the RINO’s would want a little revenge.
Miss Lindsey is one of my senators and he almost lost his last election. He should remember that when it’s time to vote.

(The President) “shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States,…”
#8 - The tricky part is where “Senators present concur.” Does that extend to all consent votes, or only treaties? I can’t recall any such case. Perhaps you do. Otherwise, it’s an interesting question. While the VP is President of the Senate, she’s not a senator.
