The Supreme Court this week heard oral argument on the Mississippi law that limits abortion after 15 weeks from conception. As someone who practiced law at the Supreme Court, I listened to the arguments. I think they’ll uphold the Mississippi law. I have a few observations. Keep in mind that oral argument at the Supreme Court is typically more theater than jurisprudence. The Justices usually already have their minds made up from reading the briefs. But it’s worthwhile theater because it connects the public to the judicial process. Also, it gives some insight into the likely decision which won’t come till next Spring.

Comments:

It seems to me that asking a woman to either (1) use birth control or (2) get her abortion in the first 3 months, is not an undue burden.

FTA - It’s because the Justices have been tasked with too many issues involving too much politics which should have been deliberated in Congress and state legislatures but the politicians there were too cowardly to tackle the issues and the people were too lazy to make them. No truer words have been written about this case. Ultimately, it is the cowards in our various levels of representative government that are to blame and that makes it the fault of the voters that put them there. Congress long ago turned over its reigns of power to the executive branch and punted tough decisions to the courts. It is foolish to assume that SCOTUS justices are apolitical. It isn't possible and never was possible. Glenn is right, but I think it is wishful thinking regarding the hope that federalism will be restored on this issue.

Will pull the allusion that overturning Roe would somehow make abortion illegal in the country. I suspect many people have been fooled into thinking that will be the case, when most of the largest, and in particular BLUE states, have trigger laws that would enact abortion just in case this might happen. New York allowed for abortions even prior to the Roe decision, so no woman should be remotely concerned in the state of NY, and many nearby states would have full access too. Same goes for California which would have trigger law establish that right in the State. Wonder how many people in those states vote specifically because of this issue alone?

#4 is exactly right. If the Supreme Court overturned R v W tomorrow, it would simply return the power to make laws concerning abortion to each state (where it should be since abortion is clearly not mentioned in the Constitution and therefore belongs to the states to make laws for their citizens). It would not suddenly make abortion illegal in the entire country no matter how much the lie-berals wale and gnash their teeth over the possiblity of it being overturned. A handful of states would outlaw abortion in all cases. A handful of states would make abortion legal up until the moment of birth. The strong majority would have some limitations on abortion, but still allow them in some or most cases. So not a single woman in this country that wanted to have a legal abortion would still be able to do so. If she was in one of those states that totally outlawed abortion, she would simply have to drive 2-3 hours (at most) to slaughter her unborn baby in a legal abortion in a neighboring state. Yes it might be a little more inconvenient. But I guess because of my morals, I think it should be a little more inconvenient to slaughter your unborn baby in your womb!!!

Some 20,000 sex criminals in Colorado get “treatment” from the state Sex Offender Management Board, or “SOMB.” It’s a big bureaucracy with layers of committees and “work groups.” Rapists treated by the SOMB are of course not called “rapists.” In fact, that term appears nowhere on the big SOMB website. It was banned years ago because it became associated with criminals who coercively, forcibly and sometimes violently prey sexually upon others – persons who commit what we used to call “rape.” Stated another way, the term “rapist” came to connote persons who rape.

Kyle Rittenhouse shot three people. The first two died. It’s interesting to see who they were. The backgrounds of these guys is not determinative of Rittenhouse’s guilt or innocence – there’s no open season on creeps – but it’s relevant in piecing together the story of that deadly night. The first who was shot served 14 years in prison for raping a child and then for dozens of in-prison disciplinary violations. He was a registered sex offender and was found guilty of assault, arson and narcotics crimes. “Woke” was coined by the left some years ago to describe a person who had become sensitive to the left’s pet issues, especially racial and “social justice” ones. It implied that a person disagreeing with the left about those issues was not just wrong, but unconscious. This catchy term was initially successful. But the left never succeeds at success. That’s because what’s important to them is not being successful in resolving grievances, but parading those grievances as evidence of their victimhood. Victim status is more important to the left than winning – and easier too.

The ACLU sued the United States for money on behalf of illegal immigrants for being separated from their children when they were caught and detained at the border. The Wall Street Journal reported a few weeks ago that the Department of Justice was considering settling the case for about $450,000 per individual – a settlement amounting to over a million dollars in the case of a family of three and over two million for a family of five. The basis for the ACLU’s lawsuit on behalf of the immigrants is not clear.

Traffic accidents illustrate the phenomenon. It was widely assumed that traffic deaths would decline during the pandemic because fewer miles were being driven. But the opposite happened. Miles driven did predictably decline in 2020 compared to 2019 – by about 13% — but traffic deaths spiked upward 7% compared to 2019. The story in 2021 is even worse. Traffic deaths in 2021 are running about 18% higher than 2020 even though miles driven are up only 13% over that one-year period. These grim figures correlate with declining use of seatbelts, more drunk driving and more speeding. COVID effectively suspended the rules of the road. That’s not all.

Last month I’d never heard of Dave Chappelle. Now I hear only of him. So, I watched his Netflix show, “The Closer.” What I saw was a clever, crude and funny entertainer. But George Carlin, he’s not. He’s not even Steve Martin or Jerry Seinfeld. He might not even be Don Rickles. The words “motherhood” and “mother” are now cancelled. The proper woke term is now “birthing person.” That’s because “mother” means a woman who has birthed a child, and allegedly we now also have men who birth a child. Never mind that these “men” have no Y chromosome and were born female with female genitalia and female chromosomes. They are now “men” because, well, because they say so. Joe Biden’s enterprising son, Hunter, has a creative side. He’s an artist. It’s not unusual for people in the public eye to have an artsy side. Winston Churchill comes to mind. Angelina Jolie recently parted with an original Churchill for about $11 million, which is probably more than she got when she parted with her last husband. But, of course, the last husband probably wasn’t as original as Churchill. And besides, Churchill won WWII, while I’m guessing Jolie’s last husband lost WWIII.

A teenage boy has been charged with terrorism and murder after a school shooting in Michigan, United States. Police allege Ethan Crumbley killed four classmates at Oxford High School with a 9mm semiautomatic handgun on Tuesday, The Sun reports.
