A Florida landlord has told tenants to get vaccinated or leave the apartment building. (Snip)In early August, Mr Alvarez sent letters to his nearly 70 employees, telling them to get their first dose by 15 August or be fired. Two employees left their jobs, the landlord said. In a letter to tenants, he urged them to get vaccinated and said new tenants would have to show proof of vaccination by 15 August and those who wanted to renew their leases were told to do the same. “You don’t want to get vaccinated? You have to move,” Mr Alvarez told The Post. “And if you don’t move, one must move forward with eviction.”

The Feds, states, employers and now at least one landlord have issued vaccination mandates. When do the "get vaccinated or get evicted" notices go out to public housing residents?

It's nearly impossible to evict a deadbeat tenant for cause, and now you think you are going to evict them for not getting a damn shot? Save your money...you are going to spend a lot of it on judgements against you.

I'm now retired, but back in the 1970s when I was fresh out of law school, one of the real estate lawyers in our large firm tagged me to work on eviction cases for a few of his clients. I probably evicted 100+ tenants. It was easy work because the tenants were always in the wrong, having no legitimate defense, unless they filed for bankruptcy. Though much time has passed since then, I'd say this landlord will soon become familiar with the eviction defense lawyers at his local Legal Aid office. He's feeling too confident. He and his lawyer will have to craft some clever legal theories from the provisions of his lease forms for the landlord's right to evict individuals for failure to vaccinate. They're not nuisance tenants. Some may be tenants at will. I'm guessing much of this is a ruse to get rid of struggling tenants paying low rental rates and tenants who have not paid rent for a year, claiming the pandemic defense, so he can move in fresh tenants paying higher rentals.

The Article's title is misleading. The Article merely asserts rt that the landlord will not RENEW the lease unless the tenant will get vaccinated. The landlord can legally do that. The landlord is threatening to have the tenant removed fro the leasehold only if the tenant will not get vaccinated and refuses to vacate the leased premises after the lease has expired. Every knowledgable landlord knows a landlord cannot evict a tenant for not getting vaccinated unless the tenant has agreed to that condition in the lease. Otherwise the landlord would be unilaterally amending the lease.
