The Justice Department will no longer pursue civil rights lawsuits based on “disparate impact theory,” the Trump administration announced Tuesday. The move comes after 50 years of government policy that encouraged lawsuits against “race neutral” policies without showing evidence of actual racial discrimination, the department said. Disparate impact theory is a framework that often assumes discrimination when there are different outcomes for different groups of people, even if there is no explicit discriminatory practice in place. “For decades, the Justice Department has used disparate-impact liability to undermine the constitutional principle that all Americans must be treated equally under the law,”

Comments:

So many counties remain under court orders to engage in this exact discriminatory conduct in hiring and promotion. Other cities and counties voluntarily and deliberately participate in these discriminatory practices.

In how many places does this practice violate the Constitution and the Bill of Rights? Let me count the ways! But this goes deeper. Are racially disparate outcomes especially in education and scholastic results, only due to social, economic, cultural and historical reasons? Or is there an element of race involved? Those who jump in to loudly deny this possibility should remember that every single foot race record in the world - from 100m to Marathon is held by a person of sub-Saharan African descent. Genes have nothing to do with it??

In modern Western adult populations, ~70–80% of individual differences in IQ are attributable to genetic differences. The median and mean IQ in Somalia is 67, for example. The cutoff for mental retardation (now called "mental disability") in the USA is 70.

The Wisconsin judge presiding over a politically-motivated case against attorneys who represented President Donald Trump in 2020 should be removed from the case on grounds of “judicial misconduct,” alleges a motion filed late Monday afternoon. Exactly what Dane County Circuit Court Judge John Hyland did is not clear from the succinct motion, but something sure stinks in the leftist hive that is the Dane County Court. Jim Troupis, a former conservative judge in that hive and the target of far-left Wisconsin Attorney General Josh Kaul’s political prosecution, filed the motion via his attorney. Apparently Hyland’s conduct was so atrocious that Troupis is looking to clear the bench.

U.S. Border Patrol Chief Michael Banks announced that nearly all illegal immigrants detained will be charged a $5,000 "apprehension fee." In a post on X on Thursday, Banks said illegal immigrants ages 14 and older who entered the country without inspection will face a fee, a provision included in the "big, beautiful bill," which President Donald Trump signed into law in July. "This message applies to all illegal aliens — regardless of where they entered, how long they’ve been in the U.S., their current location, or any ongoing immigration proceedings," Banks wrote.

Harvard Law School visiting professor Carlos Portugal Gouvea—who told authorities he fired a pellet rifle outside a synagogue on the eve of Yom Kippur "to hunt rats"—agreed to self-deport after ICE arrested him Wednesday. Gouvea—who founded a Brazilian think tank that "led the largest anti-violence campaign in the country, resulting in the enactment of the federal Gun Control Act of 2003," according to Harvard—was first arrested on Oct. 2 by the Brookline Police Department immediately following the shooting. Harvard placed Gouvea on administrative leave days later, and on Nov. 13 he pleaded guilty to illegally using the air rifle.

Ohio elections officials reached a data sharing agreement with President Donald Trump's administration that will help clean up and maintain the state's voter rolls. Ohio Secretary of State Frank LaRose announced the new agreement on Monday, saying it guarantees Ohio access to enhanced federal records for at least 20 years. The deal refers to the federal Systematic Alien Verification for Entitlements (SAVE) database, which previously had limited and costly availability to state election officials. LaRose says Monday's agreement with the Department of Homeland Security guarantees Ohio the capability to obtain verifiable data supporting each citizen verification as well as the ability to perform bulk verification requests.

California has long been a “fuel island” — a state whose gasoline and diesel markets are isolated from the rest of the country — but that could soon end under a proposed plan to build the first-ever pipeline to bring refined products directly to the West Coast. Known as the Western Gateway Pipeline, the project from oil major Phillips 66 and global pipeline giant Kinder Morgan would deliver gasoline, diesel and jet fuel to Arizona and California from as far east as Missouri by 2029. The companies are currently scoping out demand and seeking commitments from customers in what is known as an “open season.”
