Disney claims it had 'First Amendment

Disney is arguing it had a First Amendment right to fire 'Mandalorian' actress Gina Carano after she posted tweets that were out-of-step with the trans-rights movement, and an image the company claims was controversial as it pertained to the Holocaust. Carano sued the House of Mouse in February claiming the company broke the law then it retaliated against her for expressing personal political beliefs. Attorneys for the mega-entertainment brand filed a motion on Tuesday to dismiss the suit, arguing the company has a 'constitutional right not to associate its artistic expression with Carano's speech.'

Unfortunately, I agree, under the de-facto 'freedom of association' provided by the First Amendment. Just like we have the right to never consume any Disney product, the freedom to say how stupid, they are, the freedom to say that they no longer provide any sort of good entertainment (well, other than, it IS rather entertaining watching them destroy themselves.).

And I have the right not to pay for the grands to go to Disneyworld. (And trust me, the kids can't foot the bill on their own.) I hope I'm not the only one.

Google "Pedro Pascal Trump" and click the image button. Disney apparently associates its artistic expression with Pascal's speech which is their constitutional right.

Disney has the right to go woke and go broke. The court will determine the extent of a mega corporation's 1A rights. Despite a horrible USSC ruling, corporations are not people. They do not have natural rights.

Does Disney monitor all employees social media for things that might be offensive? Plenty of their more woke actors/actresses have posted and taken much more controversial public stances on issues. We're they fired too? No, because they were the correct PC stances, even if they were out of line with the family values that Disney claims to support.

First Amendment does not apply to private corporations OR citizens. It is a limitation on the Government. Contract law would be more applicable (IMHO) to this case, what does the contract between Ms Carano and Disney say about the matter? I happened to have enjoyed the Mandalorian in no small part because of her character And was really hoping for a story arc that brought the two leads together. Oh well.

Talk about twisted reasoning. First, a company does not have a First Amendment right, people have that right. And second, Disney is saying their First Amendment "right" gives them the right to violate another individual's First Amendment right. Pretty twisted, but then that is the Disney of today.

PepsiCo has recalled one of its top-selling 'zero sugar' drinks after an internal investigation found it does in fact contain sugar. The soda giant has recalled some sugar-free and caffeine-free Schweppes Zero Sugar Ginger Ale because they contain 'full sugar', according to the FDA. The FDA said in a report that 233 cases of 7.5-fluid-ounce cans (221 milliliters) cans shipped to Maryland, Pennsylvania and West Virginia were affected. It is not clear whether the recalled soda has been removed from store shelves.

Nearly every studio and outlet now has DEI requirements which translate into discriminating against qualified talent over diversity quotas. They’ve led to occasional lawsuits and government legislation to end this practice of illegal discrimination, but this is a unique lawsuit filed by a white producer against Al Roker, for not discriminating against white writers. A white liberal attacking a prominent black personality for not being DEI enough is a good snapshot of an insane racist industry where discrimination is driven more by white ideologues than minority talent.

The alarming scene that unfolded recently in Dearborn, Mich., with Muslim protesters chanting “Death to America,” has resulted in some fallout for the city’s mayor, Abdullah Hammoud. While Old Joe Biden and his henchmen are happily taking a wrecking ball to the former Land of the Free and Home of the Brave, they don’t go around telegraphing their intentions. Their friends in Dearborn were a bit too forthright about what the ultimate goal of the policies that the left and their Islamic allies really are, so reassuring words had to be uttered and the public put back to sleep.

Rep. Thomas Massie objected, complaining that the law makes government "judge, jury and executioner on such a fundamental right!" Congress approved the law anyway. A USA Today "fact check" told readers, don't worry, "There's no kill switch in Biden's bill." (Snip) The clause is buried under Section 24220 of the law.

As the workers closed in, Ortega grew increasingly upset. “They’re going to have to drag me out of here,” he said.
