Mann v. Steyn , Free-Speech Travesty

Original Article

The headlines say Michael Mann has won his defamation case and was awarded one million dollars in punitive damages. This suggests that the jury found he did not manipulate the data in his hockey stick graph which asserts that global warming is anthropogenic—that is, caused by man— is so frequently cited by "climate change" proponents. That’s not quite the whole story. The jury seems to have focused on the fact that the writers compared his work to another Penn State employee who had engaged in child molestation which the university had covered up. The defamation the jury found was not in the critique of his research

How can this be? Not only is Steyn infinitely brighter, funnier and wiser than Mann, he is absolutely correct on the issue. Somehow, the Washington jury resembles Mann in those categories.

A totally unjust verdict. The jury proclaims that Mann was so defamed by Steyn and Simberg that they should be punished to the tune of $1,000,000 so they don't do it again. They then turn around and say that the defamation was so trivial that he should only be awarded $1 in compensation. In truth, they only awarded $1 in compensation because they had to in order to award any punitive damages. It is a very easy thing to give away other peoples money. The jury evidently was in a hurry to get home.

No lawyer, me, but would someone correct me if I’m wrong. I understand that the $1 compensatory award further obligates Mark Steyn to pay mann’s legal costs. This calls for the whole verdict to be reversed.

Beg to differ. As much as I like, admire, and respect Mark Steyn, his likening anything in the climate brouhaha to the scandals involving Pedophile Sandusky was not only extremely ill-advised but totally beneath the standards he himself had set for his particular brand of journalism or commentary. I repeat, I like Mark Steyn but he made a big mistake in doing what he did and I would hope he is objective enough to acknowledge that.

Neither Steyn nor Simberg compared Mann to pedophile Sandusky. They compared Penn State’s exoneration of Sandusky to its exoneration of Michael Mann’s fraudulent “hockey stick.”

#9~ Respectfully disagree that what Mr. Steyn wrote about Mr. Mann was beneath Mr. Steyn’s personal standards so there is no need for him to feel any sense of self-flagellation or issue a public apology. According to a Wikipedia account (citing two references) of the Mann v. Steyn lawsuit, it was Competitive Enterprise Institute (CEI) blogger Rand Simberg who opined that Michael Mann’s “cover-up and whitewash” by Penn State was comparable to the Jerry Sandusky sex scandal. Mr. Steyn, in a post at National Review, “alleged that Mann’s hockey stick graph was ‘fraudulent’.” https://en.wikipedia.org/wiki/Mark_Steyn#Defamation_lawsuit Mark Steyn - Defamation Lawsuit Appreciation and blessings extended to Ms. Feldman for her continuous magnanimous and masterful expertise on behalf of people and issues that are decent and honorable.

I'd love to see the court reverse the damages award as mentioned in the article and limit the punitive damages to ten times the compensatory damages, or $10. If not the current court, then the appeals court.

President Biden couldn’t even remember when he was vice president or when his son Beau had died, leading special counsel Robert Hur to conclude that he could not bring charges for mishandling of classified documents, because a jury would see the president “as a sympathetic, well-meaning, elderly man with a poor memory.” In a report, Robert Hur concluded that Biden “willfully retained and disclosed classified materials after his vice presidency when he was a private citizen.” But he declined to issue any charges, in part because Biden’s poor recollection would make him hard to convict.

The Biden administration thinks that a reformed Palestinian Authority (PA) could run a post-war Gaza Strip at peace with Israel, but that ignores several inconvenient facts: 1) The latest poll of Palestinian public opinion shows that the PA is deeply unpopular. 2) The same poll shows that 72% of respondents supported the massacre of October 7. But somehow a new Palestinian state in Gaza would embrace coexisting with Israel? 3) The PA has an abysmal track record of corruption and was too weak to prevent a Hamas-led coup in Gaza, less than two years after Israel’s withdrawal. So why would the PA perform any better this next time?

There are many possible examples to choose from.
