In a 5-4 ruling today [pdf Available Here], Chief Justice John Roberts and Justice Amy Coney Barrett joined with the radical leftists on the court, Ketanji Brown Jackson, Elena Kagan and Sonia Sotomayor, to say that Texas is not permitted to protect itself from illegal border crossers. None of the justices provided any explanation for their vote.The court majority sided with the Biden administration policy of removing razor wire to permit illegal alien entry without impediment. Justices Samuel Alito, Neil Gorsuch, Brett Kavanaugh and Clarence Thomas voted with Texas, in favor of national border integrity. Actually this has been the SC Precedent for awhile, didn't Texas had a chance. The Border is a Federal matter. Still the State should be able to enforce crimes like trespassing.

Still, if I were Abott, I'd ask them to point out where it says the States can't protect their people. It not anywhere in the Constitution. In fact State Militias (Which include the National Guard) have historically acted to do so, against hostile natives and foreign invaders. Like Bruen, the argument is there.
Deputize some Texans to join the National Guard. Have them use force, if necessary, as was done in the Years of the Founding.

With no opinions to read, it’s hard for me to know why Barrett decided as she did. I’m guessing she was swayed by the fact that securing the border is a federal responsibility and not a state responsibility. Of course we all know the feds are not only not securing the border, they barely even pretend we have a border. Still that is an issue to be decided by elected officials, not SCOTUS. That’s likely her reasoning. It would benefit Must Read if we had a legal analysis rather than yet another jeremiad from Sundance.

After this decision there will need to be a discussion about states rights. They say the border is the responsibility of the federal government but what about instances where the government isn't living up to that responsibility and putting lives at risk? It seems that the conservatives on the SCOTUS, with a few exceptions, are just a smoke screen to make us think we have a conservative majority on the court.

Unfortunately, this ruling does not surprise. The land in question is federal land. Had the court ruled the other way, it would set a dangerous precedent in the future, which I have no doubt Democrats in blue states would totally abuse. For me, the path forward is clear -- impeach Mayorkas and Biden for breaking the law and their constitutional oath of office to defend and protect the United States. If the land in question had been state land, I think the ruling would have gone the other way.

The Supreme Court justices stated that protecting our boarders is the responsibility of the federal government and not that of the states. Why then didn’t they also state that the officials responsible for protecting the boarders are derelict in their responsibilities and are in violation of their oaths to uphold and defend the constitution of the United States? Surely, ignoring the laws on the books and ordering subordinates to the same is a criminal act.

As a lawyer, I can tell you that too much is being read into this ruling. It's a temporary measure without reasons given to allow federal border agents to move freely without impediment from Texas law enforcement. The bigger issue of whether Texas can defend its borders when the federal government refuses to do so, or only half-heartedly does so, has yet to be decided. That's why the Texas governor feels entitled to keep adding razor wire.
