This week’s decision on who to select as our top knucklehead was not an easy one, as Rep. Adam Schiff (D-CA) provided stiff competition (pun intended, and more to follow) for this week’s honoree. But Assistant Prosecutor Thomas Binger – who has led the prosecution’s murder case against Kyle Rittenhouse – has made the trial look more like an episode from the 1980s sitcom “Night Court” than a high-profile trial receiving national attention. And speaking of TV lawyers, do you suppose Binger graduated from The University of America Samoa Law School like Jimmy McGill from “Better Call Saul?”

As an arbitrator, I have had hundreds of attorneys argue cases before me, and I enjoyed the process very much. Some of the attorneys were more skilled than others, and some were simply lacking in the skills necessary to do trial work. And a few were downright stupid. (I have listened to testimony that won the case for one side or the other, and the eventual winning attorney would object to the very testimony that proved his case.) I would place Binger in that bottom group. He lacks the competence to do his job.

Nice to see P.F Whalen include this exchange in the article. Saw it live, but minimal coverage. And finally, we had this brilliant maneuver by the prosecution from Tuesday. Binger took a break from questioning witnesses, apparently exhausted from making a fool of himself, and allowed Assistant Prosecutor James Kraus to cross-examine a defense witness. But make no mistake, it was Binger’s call to pursue this line of questioning, and the accusation by the witness was directed at Binger’s actions, not Kraus’. The witness was a photographer named Nathan DeBruin, who had stated that he’d been pressured by Binger to change his statement. DeBruin’s testimony included the following: Kraus: We asked if you knew anything beyond that statement. DeBruin: Correct. Kraus: We didn’t ask you to change it? DeBruin: Yes, yes you did.

True case of asking one question too many: Binger asked: "You have no idea what Mr. Rosenbaum was ever thinking… You have never been inside his head, you never met him before… so your interpretation is completely guesswork." McGinniss rseponded "Um, well he said “Fu*k you” and he reached for his weapon." The other case: Cross examiner: "You did not see the defendant bite off the ear of Mr. Smith, did you? Witness answers: "That's correct." Cross examiner: "Than you can't testify that the defendant bit of Mr. Smith's ear, can you?" Witness responds: "I saw the defendant spit out Mr. Smith's ear.

Again, I have read that Binger is a Soros tool and I think he is following, not American law and legal procedures but a course designed to create demorat talking points for the running-dog media and to further attack America, as we know it.

He is doing the typical out of control prosecutor thing of shaping the narrative. The ONLY reason he is losing on that front is because the judge has called him out. ANY other rat judge would have let this slob and his equally stupid fat assistant, railroad an innocent man. This is a huge battle against the demonic forces on the march to destroy us, and they could still win. The blueshirt threats might cower a jury of weaklings, or not. A big stake in our collective futures is up for grabs and the rats don't follow rules or any normal moral code.

Newly released footage of the Ashli Babbitt shooting has been obtained and released by Judicial Watch. The footage is part of the 14,000 hours of documented surveillance video that the FBI and Capitol Police have refused to release to the public. The footage is striking in that it shows Capitol Police officers gathered behind the protesters while they suspiciously orchestrate a break-in of a corridor to the Senate chambers. It will now extend until March 31, 2022, which is a full four and a half months from now, and a little over two years since the World Health Organization (WHO) declared COVID-19 a pandemic. As it is with “medical expert” commentary, the state of legal analysis in the media is absolutely dire, as we’ve noted here previously. One big reason why is thanks to the strong political biases of legal analysts like CNN’s Jeffrey Toobin. While it’s not necessarily a bad thing to be a politically opinionated legal analyst, what is wrong is allowing your biases to cloud your judgment as to the specific facts of the cases/trials on which you’re being asked to provide comment and analysis. After having their entire case obliterated by video evidence and bombshell witness testimony all week – with some of the worst blows coming from their own ‘star’ witnesses – prosecutors for the state’s case against Kyle Rittenhouse finally came to the realization that their arguments had gotten them nowhere. In a shocking admission on Friday, the prosecution said that because of the evidence presented in the case “a reasonable jury or juror” could acquit Rittenhouse on the most serious charges that he faces. Even the least serious of the charges that Rittenhouse faces – illegal possession of a firearm – may be dismissed by the judge in the case.

Florida Governor Ron DeSantis has called state legislators to come together next week for a special session to consider several proposals that push back against Biden’s authoritarian COVID-19 vaccine mandates for workers and employers. Biotechnology company Moderna Therapeutics has officially begun large-scale testing of its experimental COVID-19 vaccine on America’s youngest children. On Friday, the attorney for Kelly Meggs, one of the prisoners being held without bail for events on January 6, filed a notice informing the United States District Court for the District of Columbia of a report that guards had negligently or intentionally disbursed a toxic substance in such a way that prisoners were inundated with it, resulting in several being evacuated on stretchers. Meggs’s lawyer also mentioned the dire conditions in the jail and requested, that the court release on bail those arrested in connection with events on January 6.

Watching the news, one sees constant stories about COVID numbers rising, yet again, now almost two years into this pandemic, with COVID hospitalizations in some states higher than they have ever been except for the spike last December. In my state of Colorado, the test positivity rate is almost 10 percent, with 1 in 48 infected and if the current trend continues, this will be the worst COVID spike the state has seen. On the surface, that doesn’t make sense, since nearly 80 percent of eligible Coloradans have received at least one vaccine dose, suggesting the vaccines are not working as well as they should or as advertised
