Alan Dershowitz talks the legalities of
Baldwin shooting...

Original Article

Posted By: DW626, 10/26/2021 7:19:12 AM

Alan Dershowitz, an emeritus law professor at Harvard, is one of the greatest legal minds of our time, writing multiple books and publishing hundreds of articles about the law. He has been defending clients in courtrooms since the 1970s and argued numerous cases before the Supreme Court. He was also on the team that defended Donald Trump against impeachment. Alan Dershowitz believes that Alec Baldwin’s shooting of Halyna Hutchins could be considered a homicide. Gun safety protocols are so stringent that an accident of this kind is almost impossible.

Comments:

At this point in time Alex Baldwin has killed and wounded twice as many people as everyone I’ve ever known during my sixty years on this earth. You never should’ve pointed and put your finger on the trigger there (not smart at all) Alec.

I don't know why you would need to have live ammo on the set. Hard to believe that sound engineers could not add the noise recorded from a firing range -and the actors could hold a gun with a non-bored barrel. What am I missing here?

I wonder if Baldwin's attention to gun safety would have been more acute had the script called for him to shoot himself. But then again it's Alec Baldwin we're talking about here.... stupidity and arrogance colliding with reality often ends badly. ("Cold gun" indeed.)

Re#2. That has been my question since day 1. Live ammunition should never have been on the set, let alone loaded into the weapon. Ultimately, it is/was Baldwin's responsibility to do the final check on the weapon. While I don't expect anyone to go to jail....because we have a two tier judicial system. At a minimum, several people should be held criminals negligent. And then there's OSHA.

I worked once in the 1980s on a western set actually making the dummy (authentic looking ammunition for the cartridge belts) even those were accounted for and I received them all back when it was finished production. Blanks are made in vintage style to produce realism but not fired from the prop guns at all. Ricochets, dust flying and also 'spark bullets' are sometimes fire from airsoft guns by one person using compressed air bottles not guns at all. The bullying loud mouth, Alec Baldwin, should have spent his time mastering firearm safety for the part he was playing or make a sterile western with no guns at all like his hatred of the product he advocates. Baldwins arrogance and stupidity caught up with him. What Baldwin did was the mortal sin of gun safety he now joins the ranks of the people he accuses of being. Myself as a gun owner Baldwin has outdone me with notches on his dreaded firearm. Burn in hell Alec.

baldwin pointed the "gun" and pulled the trigger. Put his ass in jail for negligent homicide AT LEAST! Another tweet Baldwin wrote about Dick Cheney's hunting accident has resurfaced. In 2006, the then-vice president accidentally shot and injured someone while hunting. Back in 2015, the actor tweeted to someone, "You hook your friends with that line? Shoot em in the face? Cheney style?"

Conclusion of the article: "...(L)egal penalties will be applied against people like Alec Baldwin who ignore the rules of gun safety or despise guns so much they never bother to learn those rules." (Emphasis added.) Those final twelve words got my attention. Baldwin has been known to exult on Twitter with something like "How does it feel to kill someone?" after some terrible accident. Now the ultimate hoplophobe and hater of all things related to firearms has perhaps criminally ended the life of another by breaking all four gun safety rules. Ultimate stupidity on display. Responsible firearm owners always adhere to Col. Jeff Cooper's Four Rules of Gun Safety. 1.) All guns are loaded. 2.) Never let the muzzle of the gun cross anything you're not willing to destroy. Keep the gun habitually pointed in a safe direction. 3.) Keep you finger off the trigger until your sights are on target and you're ready to shoot. 4.) Be aware of your target and and what's beyond the target. Unobstructed bullets can fly a long way. If you religiously keep to these gun safety rules, you should never have an accident with a firearm. But don't ever break one!

Baldwin intentionally aimed the gun at two members of the crew and pulled the trigger. There is no “accidental” about it. He’s guilty as hell. It absolutely should be considered homicide and not any lesser charge.

Sometimes when I handle firearms, I have fleeting recall of 5 gun accidents. Two high school classmates of mine were wounded in hunting accidents. Both incidents involved shotguns. A college friend shot himself in the foot with a shotgun and was fortunate he did lose his little toe. And, tragically, a friend of my parents, a physician, was killed in a shotgun accident in 1967. His son, also a physician, was killed in a shotgun accident in 2004.

I'm sure a lot of gun buffs here have wondered this. Since this was a western and the majority of the of the hand guns used in an average western movie are Colt Peacemakers. So to fire one of these guns you have to manually pull/move the hammer back. They are referred to a single action revolver. He hand to deliberately move/pull the hammer to have the gun fire. I used "pull/move" in place of a nasty word. So in my mind he intended to fire the weapon. But it having live ammunition is another story.

It was the gun's fault. Isn't that the argument every leftist states and their reason to want to restrict gun ownership. Baldwin has already started his, "it wasn't my fault" argument by blaming the person who handed him the gun. When one considers how many movies have been made over the years with guns in them , and the lack of accidents that have not happened on those movie sets, this was one of those situations that everything that could go wrong did go wrong. Every step of the way from having real ammo on the set, to no one checking the gun before handing it off, to Baldwin not treating the gun as one is suppose to treat a gun. It seems it was almost meant to happen.

OP has the right comment, he had no reason to have his finger on the trigger, even if he was practicing a scene. He should be held on negligent homicide, which may be reduced to manslaughter. And assault with a deadly weapon - for the injuries to the director. He should definitely be sued for wrongful death. Heard her husband is a lawyer who works for a politically connected law firm.

It was probably the worst day of Alec Baldwin's life when he accidentally shot and killed cinematographer Halyna Hutchins on the set of the movie "Rust" on Oct. 21. It's a time to feel terrible about a 42-year-old woman with a husband and a young son. Then, CNN's Jake Tapper used it in one of his commentaries to denounce the entire Republican Party for making this tragedy an occasion for jokes. For four continuous years, Alec Baldwin maliciously caricatured President Trump in numerous ‘comedy’ sketches on Saturday Night Live. The cycle worked as follows: The ‘brains’ in Washington contrived a scandal or outrage for that week, often related to the phony Russian Collusion narrative that loomed over Trump’s 4-year term. The figurative rifles were fired resting on the shoulders of shady lawyers, porn stars, dismissed or disgruntled personnel, anonymous ‘insiders’ and ‘leakers’.
