Why do you think Facebook is so excited about Section 230 reform and government regulation of Big Tech – did it suddenly start caring about free speech and the rights of citizens and unicorn liberation? No. We can’t throw these aspiring dictators into the briar patch that is government-run regulation. As Admiral Ackbar, and anyone who is even vaguely conscious sees, it’s a trap. There’s a better way, a way that will actually bring these creepy nanny statists to heel. It’s not traditional regulation – the creation of some sort of Department of Social Media serves the interests of both Big Tech and the Democrats, and it will make the internet substantially

There is no need to add additional laws to get big tech to stop biasing their selection of what speech is permissible on their sites. The law was written in 1964 and is known as the Civil Rights act. It made it illegal for businesses to deny public access to their facilities based on race, religion, creed, gender, or nationality. The "woke" or "socialist" principles that are being applied to exclude conservative contributors from internet platforms like Facebook and Twitter have already been determined by SCOTUS precedent to be equivalent to religious beliefs. Denying conservatives access based on a religious belief that they are "destroying the planet" or "racist dictators" is a violation of their civil rights. If significant lawsuits can be brought into federal court and won based on the 1964 Civil Rights Act the tech oligarchs will have to stop their discrimination or face serious criminal penalties without any need for more government control.

The current tech giants will eventually go the way of the big three networks, of the Detroit automakers, of any other oppressive, sclerotic oligarchy: the market will develop and embrace alternatives. As powerful and popular as Facebook, Twitter, Instagram (aka Facebook Jr), et al may be, they don't hold a royal warrant. They just happen to be the default present-day landing spots for people, most of whom aren't tech savvy and are imitators & followers. Yes, there have been plenty of competitors that have failed to draw much of a following but that won't remain a permanent condition. Frankly, many of the startups lack capital and their interfaces, user experience and site response times reflect this. The biggest hurdle is inertia. Someone who's uploaded photos for 10 years and has a circle of 500 friends (not real friends but you get the idea) will be loath to start from scratch elsewhere. Terms of Service aside, someone out there can or will write a migration tool to move data whole hog to a new social media site. There will be cyberwar but it will ultimately prove productive.
