The death penalty is officially off the table for accused healthcare CIO killer Luigi Mangione. (snip) Mangione won't technically be charged with murder in the federal case, and will instead face a charge of "stalking" Thompson, leading to the father-of-two's death. (snip) In order to seek the death penalty, Garnett wrote, prosecutors needed to show that Mangione had killed Thompson while committing another "crime of violence." (snip) The judge acknowledged that her ruling might seem "tortured and strange" to the average person, but she stressed its the legally correct move, writing that "the law must be the court's only concern."

It was clearly cold blooded murder, which should get the death penalty. Our system has failed us, and today, no one within the NE or the Left Coast will ever actually get executed, no matter what evil they do. And they'll eventually get paroled....again NO MATTER what evil the did, or are highly likely to do again.

So if Mangione had only intended to rob Thompson but ended up killing him he would be eligible for the death penalty, but although he travelled to New York with the sole aim of killing him he is not? That makes no sense.
