Supreme Court Strikes Down Trump’s Tariffs

Original Article

The Supreme Court on Friday struck down President Trump’s tariffs after finding the International Emergency Economic Powers Act did not give him the power to impose sweeping protectionist measures. The Court upheld an earlier federal circuit court ruling in a 6-3 decision, with Justices Clarence Thomas, Samuel Alito and Brett Kavanaugh dissenting. “Based on two words separated by 16 others in … IEEPA,” Chief Justice John Roberts writes, “‘regulate’ and ‘importation’–the President asserts the independent power to impose tariffs on imports from any country, of any product, at any rate, for any amount of time.

Notice that the Supreme Court issued this long awaited anti-Trump opinion giving the leftist Democrats a seemingly big victory just a few days before Trump is scheduled to give his State of the Union Address. What does that in itself tell you? They are saying that Congress could change that law to allow Presidents to put tariffs in place as Trump has done, but can you even imagine the wimpy Congressional Republicans and their RINO class doing that? Beyond that, it is a 101% sure thing that the leftist, progressive, and socialist Democrats would never go along with any such change, as they have shown that they have been out from the get-go to sabotage Trump’s political agenda.

President Trump was standing against China in a desperate trade war for the survival of the American worker against Chinese slave labor, and the SCOTUS just disarmed him. Once again, the liberal elites showed they are useful idiots in the destruction of America by global barbarians.

The Judges failed to actually LOOK AT THE LAW. Section 232 of the Trade Expansion Act of 1962, which allows the president to impose tariffs if imports threaten national security, and Section 301 of the Trade Act of 1974, which permits retaliatory tariffs against unfair foreign trade practices. It is quite clear the Judges are POLITICAL HACKS doing their normal LYING!

Trump is suppose to be visiting China in the next week or two - cancel the trip. No way he can negotiate with China now. China, India, EU, etc - don't have to worry about a Supreme Court interference. So once again the elites in this country show their true colors as they celebrate the one thing that one President was doing to help our economy. They just cannot stand his (and ours) success.

Ridiculous. Tariffs are RECIPROCAL, at levels specific for each market / country, based on negotiations with each market's authorities, should not qualify as "sweeping protectionist measures".

Surprise! Surprise! Actually, no, not really. Just an observation. How many things has Trump done that no other politician would do? Tariffs is just one. Expelling the illegals and closing the border are others. Others are Greenland and the Gulf Of America. No doubt there are others. This is what sets Trump apart from our other politicians. In many ways he is neither a Democrat or a Republican. He has shown everyone there is an alternative to how things get done. Our nation probably needs that. Trump is actually fixing things. Both parties hate that. It upsets all the shady deals they have made with America's enemies.

Ed wrote this morning about reports that Trump is considering limited strikes on Iran in order to prod them to move to our position on disarmament. He rightly notes that "limited" strikes are exactly the wrong way to go, which is why I believe these reports are basically disinformation, meant to suggest that massive strikes are not imminent. The rational order of battle should be the opposite. First, take out the anti-aircraft and radar systems in Iran with stealth bombers and fighters, and immediately after start going after the launchers on a massive first wave. We wouldn't get all of them or even most of them the first time,

In a 6-3 Friday, the Supreme Court blocked President Donald Trump’s imposition of reciprocal tariffs, which the president had successfully used to raise much-needed government revenue and level the playing field with countries charging exorbitant tariffs on U.S. goods. The decision upheld rulings by lower courts declaring Trump’s use of a presidential emergency power provision to unilaterally impose the tariffs unconstitutional. The ruling invalidating Trump’s tariffs immediately sparked extravagant conjecture and commentary about the implications of the decision. “It is important to be clear about what the Supreme Court’s decision on IEEPA does — and does not — do,” Rep. MILAN — For its first six games at these Winter Olympics, the U.S. women’s hockey team was unbeaten and unchallenged. Yet for the first 58 minutes of Thursday’s gold medal game, it looked unnerved — unable to score and headed toward a stunning upset against its archrival, Canada. Nine days after the U.S. had riddled Canada's defense for five goals in a group-play rout, that same Canadian defense had transformed into a stonewalling unit that had shut out the most unstoppable offense of the Milan Cortina Olympics. Then Hilary Knight, the U.S. captain playing in her fifth and final Olympics, skated in front of the Canadian goal with two minutes remaining

Citing people familiar with the matter, the newspaper reported that if approved, the strike could take place within days and would target military or government sites. Don’t worry: Friday’s Supreme Court decision limiting some of President Donald Trump’s tariff powers won’t derail his larger, vital project of rebalancing US trade relations, boosting US industry and safeguarding US supply chains — nor should it. Yes, he’ll need to find other ways (more permanent and legally airtight) to pursue those goals, but the high court’s ruling against his across-the-board tariffs illegal also made it clear he has many such tools at his disposal — including other tariff powers. Even many of his allies warned that imposing import duties under the International Emergency Economic Powers Act was legally dubious;

Few things in Washington, D.C., generate as much as excitement and intrigue as a Supreme Court confirmation showdown. For decades, since the eponymous "borking" of then-Supreme Court nominee Bob Bork in 1987, political battles surrounding the membership of the nation's high court have been among the most contentious and raucous of Beltway affairs. Which is why it's rather curious that very few outside the most fervid of court-watchers seem to be discussing the distinct possibility that there could be one or two Supreme Court vacancies after the current term ends this summer.

The United States government (USG) should not go to war with Iran. Iran’s nuclear program is not a meaningful threat to the United States. How Iran is governed, how its government treats its people, and who the Iranians trade with is none of our business. A genuinely America First strategy toward Iran would mean ignoring the country and the Middle East as a whole. The United States government has no core interests on the Asian landmass. The USG should lift all trade sanctions on the Iranian regime, grant diplomatic recognition to whatever regime is currently in power there, and cease efforts to regulate or manage the Iranian nuclear program.
