If Rogue Judges Keep Thwarting The People’s
Will, Congress Should Abolish Judgeships

Original Article

Since President Trump returned to the White House, activist judges — mostly from deep-blue strongholds like California, D.C., and Massachusetts — have lined up to sabotage his agenda.  These judges have thrown out wave after wave of temporary restraining orders and nationwide injunctions to block his key initiatives: shutting down toxic DEI programs, deporting dangerous criminal illegal aliens, and slashing wasteful foreign aid.

Comments:

The article makes reference to Thomas Jefferson’s abolishing rogue courts through the Judiciary Act of 1802, terminating the judges along with them. “The Supreme Court backed it up in Stuart v. Laird, and that decision still stands today. Congress doesn’t need a supermajority to abolish lower courts. Just a majority. No impeachment, no drawn-out hearings, no smoke and mirrors, just a simple vote.” Let’s do this!

While the Republicans have the majority, though slight, go ahead and abolish the judeships, if the Supremes won't stop this rogue judges. Confidence in the Supreme court seems to be low these days, they should start honoring the the power of the president, instead of pussyfooting around these lowly federal judges, trying to use their low court to thwart the president. And while they are at it find a way to get rid of Roberts too.

I don't like the idea of abolishing judgeships. It seems excessive. Instead, define the power of the lower courts to be what they have assumed to be by tradition. District judges handle cases IN THEIR DISTRICT, period. If the plaintiff is in the district they can bring suit. Perhaps there should be a new National court dedicated to nationwide, and only nationwide, cases. No nationwide injunctions by district judges. District judges are confined to actions on the case brought to them in the location it has occurred. We should also wonder why so many of these cases are ending up with Leftist judges. The assignment system should be bound to district cases OR randomized for national cases OR to the new National court for broad scope issues. Perhaps cases involving the Executive's actions should go directly to the SCOTUS. Why should a district court make decisions regarding the President? Any result is going to end up before the SCOTUS anyway. OR create a Gateway trial court for Presidential actions since since the SCOTUS is essentially an appeals court. We have asked the SCOTUS to set a tone to fix the court system's poor behavior. They have refused to do so. Congress should impose a new structure that will fix the problems.

It's way beyond the time to "take off the gloves". If the law exists, use it. The lawfare mob makes up and distorts the law and uses it to financially ruin not only the powerful but the everyday citizen. It's all about power and control. Use real law to put "the fear of God" into them especially when the quisling Congress is so gutless.

Discipline, courage and vision are required to pull this off. In my lifetime, I have never seen the Refublican part pull all three off to accomplish a goal. Yes, individuals in the Refublican party have exhibited these virtues. Usually leaders. But the Refublican party has so rarely produced leaders. on a grand congressional scale. It's a great idea. Will never happen!

Let’s face it, Congress won’t do anything and will ultimately be the undoing of the MAGA movement. They can’t even agree to cut the wasteful spending that DOGE has uncovered. They won’t reform the judiciary either, the other branches of government are just waiting Trump out and will keep doing what they’ve been doing, at least until the debt bomb explodes, then we will all pay dearly for it.

Congressional Republicans are not going to do anything except tell us over and over what the problem is, and how we just need to elect more Republicans to fix it.

There are 677 authorized federal district judgeships in the United States across the 94 federal district courts. Apparently each and every one of them thinks they have the authority to hold up the policies of the executive Branch indefinitely.

The battle between the Trump administration and the federal courts on the topic of deportation is intensifying. The outlines are clear. Biden and his corrupt cronies left the U.S. southern border wide open for four years. Estimates vary but it’s likely 8 million illegal aliens crossed the border. But the actual number could be 10 million or higher. Of course, some just came for a better opportunity, but many were murderers, terrorists, rapists, sex traffickers, Chinese spies and every sort of violent low life you can imagine.

Despite landslide victories in 2024 that put Trump in the Presidency and Republicans in control of Congress, Trump’s agenda to reverse the Biden Immigration Invasion is being aggressively blocked by radical activist federal judges…Though Trump’s DOJ has scored reversals in some of the more egregious cases, many federal district court judges still find ways to ignore the higher court rulings. Or they simply order new overreaching temporary restraining orders (TROs) that under court rules ordinarily can’t be appealed for a period as long as 28 days. Then the same or different judge comes along with a new bizarre TRO to keep deportations frozen or derailed. It’s assembly line lawfare.

As aspects of President Donald Trump's agenda are stymied by judges amid legal challenges, Florida Gov. Ron DeSantis has suggested that Congress could strip federal courts of jurisdiction. "Congress has the authority to strip jurisdiction of the federal courts to decide these cases in the first place. The sabotaging of President Trump’s agenda by ‘resistance’ judges was predictable — why no jurisdiction-stripping bills tee’d up at the onset of this Congress?" DeSantis wrote in a Wednesday post on X.
