Trump's 'Nuclear' Deportation Options

Original Article

Posted By: Elljay, 5/11/2025 4:35:11 PM

The battle between the Trump administration and the federal courts on the topic of deportation is intensifying. The outlines are clear. Biden and his corrupt cronies left the U.S. southern border wide open for four years. Estimates vary but it’s likely 8 million illegal aliens crossed the border. But the actual number could be 10 million or higher. Of course, some just came for a better opportunity, but many were murderers, terrorists, rapists, sex traffickers, Chinese spies and every sort of violent low life you can imagine.

Comments:

We’re in a civil war with the courts and it’s time to take the gloves off.

One option not discussed in the article: getting the Senate to pass the No Rogue Rulings Act that was passed by the House, though to do so would require ending the rule permitting filibusters: https://substack.com/@elljay/note/p-163306060?r=6x5ug&utm_medium=ios&utm_source=notes-share-action

I say Trump should simply declare a national emergency implementing aspects of martial law, whereby he can bypass the courts altogether and conduct massive deportations. Either that or simply move all deportations over to the military courts.

Ignoring the courts is not only not unconstitutional, it is constitutional. The Constitution gives the President broad powers to enforce the law and makes no mention of the courts assuming executive powers. Thus, not allowing the courts to affect executive actions is constitutional. The DemoRoids are hoping to delay the deportations so they can increase the number of House seats and thus Electoral votes using illegal aliens counted in the census. The thing about it is, only the DemoRoid base is in favor of keeping illegal aliens, including the scum of the earth, in the US. Having illegal aliens rob, rape, murder, etc. American citizens will win them no friends and will create new DemoRoid opponents, not to mention shrink their base. Having more electoral votes and House Representatives will do Blue State DemoRoids any good if their opposition to mass deportation results in those Blue States turning red. Talk about being hoist by your own petard!

What the Congress should do through legislation, is severely limit the right of illegal aliens who last entered the USA by crossing the border unlawfully without being inspected and admitted to the USA, who are commonly referred to as being EWI’s. That would cover the vast majority of the illegal aliens who were able to sneak into the USA by the leftist and progressive Democrat Biden crew. The way to do that is by not qualifying them to have a court hearing in the immigration courts before an immigration judge with rights of appeal up through both the immigration and criminal courts all the way to the US Supreme Court, but instead afford them an appearance before a Special Inquiry officer, who is a specially trained immigration officer. At that appearance once the Special Inquiry Officer determines that the respondent is not a citizen or national of the USA, and that the respondent last gained entry to the USA by unlawfully crossing the border without having been inspected and admitted to the USA by an immigration officer, that a final order of deportation immediately comes into affect, with no appeal, upon which the respondent is transported to the borderline where his or her physical deportation is effected. In most cases during such proceeding most illegal aliens who are EWI’s could be actually deported within 48 hours.

Congress has done nothing and will do nothing to help Trump. They will never defund the DC courts. Maybe If the Clowen Piwen strategy bottles up the courts WE can proceed with deportations even after we lose the House in the midterms because the Judicial branch will be non functional. I think the publicity of the Abrego Garcia case is very good for us.

Despite landslide victories in 2024 that put Trump in the Presidency and Republicans in control of Congress, Trump’s agenda to reverse the Biden Immigration Invasion is being aggressively blocked by radical activist federal judges…Though Trump’s DOJ has scored reversals in some of the more egregious cases, many federal district court judges still find ways to ignore the higher court rulings. Or they simply order new overreaching temporary restraining orders (TROs) that under court rules ordinarily can’t be appealed for a period as long as 28 days. Then the same or different judge comes along with a new bizarre TRO to keep deportations frozen or derailed. It’s assembly line lawfare.

As aspects of President Donald Trump's agenda are stymied by judges amid legal challenges, Florida Gov. Ron DeSantis has suggested that Congress could strip federal courts of jurisdiction. "Congress has the authority to strip jurisdiction of the federal courts to decide these cases in the first place. The sabotaging of President Trump’s agenda by ‘resistance’ judges was predictable — why no jurisdiction-stripping bills tee’d up at the onset of this Congress?" DeSantis wrote in a Wednesday post on X.

If you wondered since 2016 how come the blob and the Democratic Party were aligned so exquisitely in their operations to destroy populism (personified by Mr. Trump) and to permanently entrench single party power in America for all time to come, it’s because an endless font of taxpayer money was streamed into countless non-governmental orgs creating a shadow civil service of Democratic Party activists that melded seamlessly with the big policy-making agencies.

The Democrats assume that constantly casting Trump as Hitler is all that’s needed to win the election. The central argument at their convention, spoken and implied ad nauseam, was: Anyone with a pulse is going to beat Evil Orange Man. So outlining policies and engaging with the press are therefore unnecessary risks to avoid.  Don’t spoil the makeover of the empty pantsuit. Defeating the evil dictator is the only thing everyone needs to concentrate on. But then along comes RFK to upset the Potemkin apple cart.

The hour is late for “Joe Biden.” His sojourn in America’s highest office was one long twilight of pretending to be effectual, or merely present, and now even that abject pantomime slips into a place of nullity, where all is still and dark. What does he do these languorous weekends at the fabled Delaware beach house? Stare out at the empty Atlantic horizon over an uneaten egg salad sandwich with the crusts cut off? Does he even suspect that the world is already turning without him?

It allows expropriation (seizure) of land without compensation. The law mandates “just and equitable” compensation in most cases, with judicial oversight for disputes. Ahh, "equitable."
