A pregnant Texas woman who was ticketed for driving in the HOV lane suggested that Roe v. Wade being overturned by the Supreme Court means that her fetus counted as a passenger, and that she should not have been cited. Brandy Bottone was recently driving down Central Expressway in Dallas when she was stopped by a sheriff’s deputy at an HOV checkpoint to see whether there were at least two occupants per vehicle as mandated.

Interesting conundrum. Let's see how "Life begins at conception" Texas is. Were I the judge, I would find in the woman's favor. It is unlikely that the HOV lanes will now be flooded with pregnant woman drivers. The impact in that sense would be de minimus. The impact socially would be potentially enormous.

Technically, she does have 2 persons wherever she goes. The complication here is that the intent for HOV lanes was to encourage drivers to carpool instead of driving separate cars. And since she and her baby simply cannot be in different cars, no reduction of road traffic can ever be achieved. But if the baby in her womb counts as another passenger for planes, trains, or hotels, it should count as another in her car.

(And, of course, no passengers under driving age could ever be a reduction in traffic, either, then they aren't within the original intent of the HOV lanes, either. But until underage passengers are left out of the passenger count for HOV enforcement, unborn babies should count, too...)

I was in the insurance business for over 40 years and recall a claim I read about. Seems the husband died and in addition to life insurance, he had a generous disability policy. She tried to claim on that also stating that he was now "disabled". No doubt that he was truly disabled...he was dead, but the widow was unsuccessful. Good try though.

This type of case was tried once already, in Washington state I believe, and the defendant lost. It’ll be interesting to see what happens here

From a practical standpoint.....give her a warning and announce publicly that pregnant women do NOT count as two for the purposes of the HOV lane. Let everyone win on this one.

When Sen. Marco Rubio (R–Fla.) was seeking the 2016 Republican presidential nomination, a local paper noted that he had "a long history speaking out against marijuana legalization." Given that history and the fact that Rubio's position is rejected by two-thirds of Americans, you might think he would be prepared to defend marijuana prohibition with cogent arguments. The study published Wednesday in the journal The Lancet estimates that by mid-2019, there were 450 fewer cases of cervical cancer and 17,200 fewer cases of pre-cancers than expected in the vaccinated population. Researchers at Kings College London and the British government looked at population-based cancer registry data in the UK between January 2006 and June 2019 for seven groups of women, comparing those who were vaccinated to those who were not.

As expected, the Biden administration released proposed new rules for pistol braces and model legislation for "red flag" laws that make it easier to confiscate privately owned firearms. Also as expected, the proposals are ludicrous. On the one hand, they are pointless and nitpicky rules that are ultimately unenforceable, and on the other hand they are dangerous end-runs around due process that threaten fundamental rights. Taken together, they illustrate the unserious nature of gun regulations which are crafted more to appeal to political audiences than to achieve positive results.
