Attorney General Merrick Garland on Monday said that immigration judges can now consider the mental health status of an illegal immigrant convicted of an aggravated felony when considering their asylum claim or whether to withhold their deportation -- overruling a prior decision by a top immigration appeals board.
The Immigration and Nationality Act makes illegal immigrants ineligible for both asylum and withholding of removal -- where illegal immigrants are not returned because they have a fear of persecution if returned to their country of origin -- if they have been convicted of a "particularly serious crime" that constitutes a danger to the community.

This political hack has zero authority to tell judges what to consider. They need to read the LAWS, the words printed on the pages, not what some crooked leftist with stolen job title says.
If the are already crazy, send them home. And if it will make them crazy, even suicidal - too darned bad.
Send illegals home.

WE have crossed the Rubicon and now are no longer a two tired system of Just-Us. We now have no laws. All an Illegal has to do, whether they murder, raped, been a mule, robbed or set fire to a forest, is claim they want to be the opposite sex and voila, there in. Does Merrick Garland have this kind of power? He is now going to decide who is and who is not eligible to come into this country! This administration has abandoned the rule of law and Constitution and replaced it with democrat dogma. Will the Republican leadership issue and strongly worded statement or offer a polite rebuke? Don’t count on it.

Those immigration judges should not be called judges, but rather administrators, because if they follow Merrick Garland's instructions then they are not following the law.

Once the word gets out in the illegal alien universe just about every illegal alien who will apply for asylum in the USA will claim that he or she has mental health situations and they should not be deported because they will not be able to get as good mental health care in their home countries as they would be able to obtain “free” in the USA. Garland just complicated what will be many millions of asylum cases the vast majority of them bogus or fraudulent.

This just highlights the fallacy that many people believe about illegal aliens seeking "asylum" in our country. The average American believes that the so-called hearing on granting the illegal permission to stay (basically handing them a substitute green card/visa) is decided by a Federal judge who is truly versed in the law. Wrong! The cases can now be heard by a "justice department administrator" --- much like a traffic court arbitrator --- and he/she gives the rubber stamp on the asylum application. These "judges" report to the DOJ and thus are under Garlic-land's authority. He's giving them orders, not making suggestions or recommendations.
If you don't hand out amnesty to most of the illegals coming before you then all of a sudden the DOJ will no longer be needing your services!
We're doomed unless we start deporting these criminals.

The Attorney General does not decide what judges may or may not consider. It’s the other way round. Judges consider the law.

In general, the vast majority of asylum cases are not heard in the federal courts, but administratively by immigration judges in an administrative immigration court of by other administratively and politically appointed inviduals in the Department of Justice who are appointed under the jurisdiction of the Attorney General. Those administrative judges and others appointed by the Attorney General are bound and required to follow all the administrative orders from the Attorney General, such as the current mental health considerations that the Attorney General ordered obviously to the favor of criminal and illegal aliens, and have no discretion to not obey that order from the Attorney General. In that respect we are now bound to see a huge number of borderline asylum claims be granted based on claimed mental health situations, as before the Attorney General’s order, most of those asylum claims were denied as being based upon ineligible claims or because they were completely fraudulently.

My first thought mirrors poster #1. It is a blessing that Garland, as incompetent as he is as AG, is not on the SCOTUS.
There is NO BENEFIT to the United States in admitting mentally ill criminal illegals. Look at any American city today, and understand that the homeless encampments are largely filled with our OWN mentally ill. In many cases, the families of these folks tried to help their loved ones, or tried to get help from local agencies. But the most severely ill people need far more than families or outpatient services can provide. The mental hospitals that were available in the 1950s were emptied long ago, based on an overly optimistic belief that new drugs would make treating the mentally ill in community centers possible.
Alas, no such wonder drugs materialized, and without those hospitals, burned out families were left with nowhere to turn. Families don't want their loved ones living on the streets, but they have no power, and few places to have them committed. Garland knows this. But like Joe Biden, he's using his power to further burden the American people. No matter what this administration decides to do, it's a sure bet it won't be good for Americans.
