NEW YORK - A federal appeals court on Friday revived a lawsuit against Fox News Network over its reporting on Seth Rich, a former Democratic National Committee employee whose unsolved murder sparked uncorroborated right-wing conspiracy theories. The 2nd U.S. Circuit Court of Appeals in Manhattan said Rich’s parents, Joel and Mary Rich, could sue Fox News for causing emotional distress by publishing a May 16, 2017, article claiming their son had leaked DNC emails to WikiLeaks, implying that the leaks were related to his death. Fox News, a unit of Fox Corp, retracted the article a week later, saying it


Most of the media has had little interest in investigating his murder. Yet his parents want to sue the one outlet that was concerned about his death.

Such a suspicious death, in the middle of the 2016 election campaign and amidst all sorts of allegations of spying and leaking. The data that was supposedly hacked was shown to have timestamps consistent with a data transfer rate on a thumb drive. It's always been rumored that Seth Rich was at odds with the DNC for throwing all their support behind Hillary instead of his choice, Bernie. I think it was an inside job, that Rich was involved, and he was silenced.

Maybe the "discovery" phase will find out that the Democrats have gotten to Mr. & Mrs. Rich much like the Kennedys got to Mr. & Mrs. Kopechne fifty years ago. I still think it is very possible that young Mr. Rich was the source of the leaked emails to Wikileaks and not some shadowy Russian hack. Maybe that's why the DNC wouldn't even turn over their equipment to what was an extremely helpful and subservient FBI/DOJ. Something tells me that this lawsuit won't even make it to the discovery phase.

The fact that the details of the story were eventually found to not be true is not relevant. It has to be shown that Fox reported the story with harmful intent which I doubt can be shown since they had no motive to harm anyone. The more interesting aspect of this is the report that Breitbart published some weeks ago. Ed Butowsky says that Fox contributor Ellen Ratner had spoken with Asange directly and was told that Seth Rich was the original source of the DNC emails. He also says that Rich's father had confirmed this to an investigator at the time. The story has gone dark since then but it was a stunning revelation if it is corroborated by Ratner.

What was taken from his corpse? He still had his wallet, credit cards, cash, watch and some papers and receipts. If it was a robbery, why was nothing taken? What's that smell? Is there a dead fish in this story?

"Discovery" cuts both ways. The Clintons are batting a thousand so far. The courts will not be called into this affair by the Rich family. Asserting that they "Can" is not the same as pledging that they will.

Microsoft attempts to fix the various issues plaguing Windows 10, but the latest patch release only caused more problems in the system. It's been tough going for Microsoft when it comes to Windows 10. Specifically, the patch caused issues in the search option of the Start menu and Taskbar. Microsoft released a patch called KB4515384 on Tuesday, Sept. 10, which was meant to address issues in Cortana and SearchUI functionality causing high CPU spikes and the Desktop Search to cease functioning properly.
