The U.S. Court of International Trade on May 7 struck down President Donald Trump’s 10-percent global tariffs under the Trade Act of 1974. The court ruled 2–1 in favor of small businesses and several states that contested the tariffs, which had taken effect on Feb. 24. The dissenting judge said it was premature to rule on the dispute. The challengers had argued that the tariffs were the Trump administration’s attempt to sidestep a U.S. Supreme Court ruling that struck down the president’s tariffs levied under the International Emergency Economic Powers Act.

Re: #1 - No, the Constitution places tariff authority in Article 1, Section 8, giving the authority expressly to Congress, along with the power to tax and spend, to borrow, and to regulate commence - all of which are enumerated powers of Congress, being those powers specifically identified in the Constitution. Implied powers are those powers, not explicitly stated but necessary to effectuate powers enumerated in the Constitution; consequently, implied powers do not trump enumerated powers. The ability of Congress to delegate enumerated powers to the Executive Branch has always been controversial. In Supreme Court cases where the enumerated authority of Congress has been delegated to the president by legislation, the Court has upheld such delegation provided that specific limits and conditions (e.g., the intelligible principle test) be placed on such authority. "Global tariff" authority exceeds such limits and conditions and does not pass the intelligible principle test.

This isn't over. The two judges who ruled against the President are Never-Trump Obama judges. The Supreme Court's ruling that the new tariffs supposedly seek to evade held that the President had used the wrong statutory authority to impose the initial tariffs and Justice Kavanaugh's opinion provided a roadmap for which authorities Trump should use in imposing future tariffs which the Administration presumably followed.

It is a proper judgment. Emergency Powers delegated by Congress were exceeded by the "Global" nature of the Trump tariffs. The Constitution needs to be upheld. There are other ways of doing it as Judge Kavanaugh's opinion outlines.

The South Carolina House voted last night to open the door for redistricting in a special session a week from now. The measure still has to pass the South Carolina Senate; however, with the Indiana outcome at the forefront of their political future, the redistricting is more than likely. As a consequence, South Carolina Democrat James Clyburn is potentially going to lose his gerrymandered seat in congress. Given Clyburn’s stature as one of the key architects of the DNC ballot harvesting and election counting fraud via the AME Church network, Democrats are apoplectic.

The issue behind the Saudi decision is not that complicated if you understand the longer-term background. Tennessee State Rep. Justin Pearson is known for his disingenuously performative political stunts. He took it too far again on Thursday, screaming in the face of state troopers — completely unprovoked — because his state’s redistricting special session didn’t turn out the way he had hoped. To quote Pearson: “Move the f*** back! Boy! The f*** is wrong with you? A Frontier Airlines plane aborted takeoff after it struck a person on a runway at Denver International Airport late Friday, a spokesperson for the carrier and the Federal Aviation Administration told CNN. Flight 4345, an Airbus A321, was departing from Denver en route to Los Angeles and carried 224 passengers and 7 crew members, Frontier Airlines said in a statement. It's incredibly demoralizing to law-abiding, rule-following, normal Americans to watch Democrats publicly commit crimes without ever getting in trouble for it. I’m not talking about the indictments and prosecutions of high-level Democrats on charges that may or may not hold up in court — the Jim Comeys and Letitia Jameses. These prosecutions may or may not be at least partly politically motivated, but Democrats will always think that's all they were. And the refined legal arguments for conviction stand little chance of success in leftist jurisdictions like Washington and New York. I’m talking about Democrat politicians who knowingly flout the law, brazenly and openly, on video for all to see.

On Wednesday, Cam wrote about a YouTube channel publishing AI slop, claiming that carry permits were struck down nationwide. That's one of those "big if true" moments that we all know isn't true. They could have done that with the Bruen decision, if so inclined, and this is the same court that ruled there. Transportation Secretary Sean Duffy confirmed that the shocking accident Friday night in which one individual was killed and more than a dozen more injured was the result of a deliberate trespass on the part of the dead man. Duffy’s conclusion was to warn people not to trespass at airports, because, of course, they are not prepared for random people to run suddenly across runways.
