During oral arguments at the Supreme Court on Wednesday, Justice Ketanji Brown Jackson made her case for why the children of foreign tourists ought to qualify for birthright American citizenship if they are born in the United States while their parents are on vacation.
The case, known as Trump v. Barbara, will decide whether or not President Donald Trump’s executive order to end birthright citizenship for the U.S.-born children of illegal aliens and foreign tourists, often referred to as “anchor babies,” is constitutional.
During an exchange with the ACLU’s Cecillia Wang, who is arguing that the order is unconstitutional, Jackson seemingly made a case for why birthright citizenship should extend to foreigners

Listened to the session on Fox. It's amazing how much of the case seems to come down to the definitions of the words "domicile" and "allegiance", which the opposition tried like a pretzel to go around the common understanding of their meanings at the times of their writing. Their attorney even seemed to propose that allegiances were temporary and portable, depending on who and where you are - she tried to conflate "allegiance" with "vulnerability", as in , a foreigner has a temporary "allegiance" to the U.S. and Constitution while in America, just because they can be arrested and punished for violating U.S. law..!?

They talked about English Common Law as being the reason that birthright citizenship came to be in the USA, as I understood what they were saying in the Supreme Court. But I did not hear them say that the U.K., where English Common Law was created, essentially abandoned birthright citizenship decades ago in favor of parental citizenship, whereby the citizenship of the child’s parents determined the child’s citizenship.

i had thought that this was going to be a 6-3 vote in support of Trump. Now I believe it will be a 5-4 loss, perhaps even a 6-3 loss.
Maybe it is time for an executive order holding all pregnant immigrants/tourist who come here in quarantine for nine months to ensure that they don't have the dreaded COVID virus. Quarantined residents to reside in Gitmo, not on American soil. Then they can live in Cuba if they want to.

I was in the Navy when the great Clarence Thomas went through his confirmation hearings. It was as he aptly put a "high tech lynching." Some of my fellow Black sailors had very unpleasant things to say about him but I saw his as a great jurist who would do great things if he was selected. Thankfully for our republic he was. Contrast what he endured to how the most idiotic person in Ketanji Brown Jackson's confirmation went. Also, how she's continuing to be celebrated by the left especially the Black left. It boggles my mind as to how someone who has constantly made flat out stupid arguments like this latest one gets praise. While Justice Thomas still gets derision. Okay, we all agree KBJ is an idiot but how do you explain the likes of Chief Justice Roberts and Comey Barrett? Allegiance is one thing (something you choose) as opposed to being under the authority of laws of the land you are visiting.
These justices are so far removed from regular life that they and their children do not need to worry about foreign nationals and illegal aliens being any threat to them whether it is college (Ivy League of course) admissions, six figure BS jibs with some think tank, secure and safe neighborhoods, etc.
We overthrew a King only to be ruled by mini kings in black robes.

This person should have never been confirmed. Marsha Blackburn should have pushed harder when she gave the ridiculous answer that did not know the definition of a woman because she was not a biologist.
