I’m not a lawyer, but I‘ve never quite understood how burning the American flag is a “free speech” issue. Lighting a flag on fire isn’t the same as giving your opinion or writing an article—it’s an action. If I took my bedsheet and lit it on fire on Fifth Avenue, I’m pretty sure a cop would be stopping by shortly.
Donald Trump is certainly no fan of flag-burning, and on Monday, he signed an executive order banning the practice. Titled PROSECUTING BURNING OF THE AMERICAN FLAG, the order vows to restore the “sanctity” of the Stars and Stripes:
My Administration will act to restore respect and sanctity to the American Flag

Not a fan of this. The important thing is to reduce the number of people who want to burn our beautiful flag (e.g., better history in schools, cleaning up the museums, deporting aliens who disrespect our country, etc.). Outlawing the symptom isn't all that helpful.

In addition, the "progressives" wouldn't mind book burning.

Our kids do not study American history. The flag does not mean to them what it means to us older people. A better start would be mandating American history in schools. I agree 100% about arresting those who burn the flag, I just think it's a small hill to die on right now. But I'll back him on this.

Fabulous! Sick and tired of seeing Mexican or Palestinian rags paraded around. The illegals under the bidet when they approached OUR border were waving and carrying the rags of their respective countries. If you are so proud of your dirt bag country STAY there.

SCOTUS having ruled this a "free speech" issue, I suggest that the Administration treat it exactly as such: henceforth, burning or similar destruction of the American flag will be regarded as the equivalent of saying, "I renounce my American citizenship." No criminal penalty, but the now-alien had better scramble to secure his/her/its/their/other right to remain in this country.

The 1st Amendment guarantees us free speech . The left decided that was too much so they came up with
" hate " speech " and it's a crime. So according to the lefts constipated thinking ( burning our flag is not an act of love ) setting fire to our flag is a hate crime.. Personally I have no use for " hate" speech or its brother,
" hate " crime. Limited speech is not free speech. A crime is either crime or it's not.......me calling you
a racial epithet is my right. Me beating you up is not.In our world of multiple standards , try burning a koran and see what happens.

Trump knows this won't pass judicial muster - at any level - even in Texas. He doesn't care. This is simply virtue signaling aimed at making the MAGA crowd ecstatic. He wants to force his opponents to take the opposite side. One more 80:20 issue that the Dims will be on the wrong side.

Burning ANYTHING in public is Arson, as well Creating a Public Disturbance, demanding full application of the Law, with a prosecutorial directive to seek the fullest penalties avaiable, is just fine with me

Trump probably wanted to have flag-burners sent to hell. PDJT might have pulled that off, if not for another activist judge appointed by Barry or Brandon.

#7. You are probably right that in the cases involving US citizens, burning the American flag will not pass muster as being a criminal offense. But that does not in anyway mean the Congress cannot make burning the American flag a deportable offense in the immigration laws, by which aliens, defined as any person not a citizen or national of the USA, who is subject to the immigration laws, could find herself or himself subject to being deported from the USA for burning the American flag. It’s up to Congress!

This is wrong on so many levels. I am once again disappointed in Trump and thats becoming more and more frequent lately. Burning the flag, as lousy as it seems, is making a statement. The flag is not the country or a person, it is an inanimate object; a symbol of what should have been but with no sentience of its own. I offered my life under that flag and I've also been ashamed to fly it at times.
The president should have bigger fish to fry. I'm starting to wonder if the libs dont have a point about him.

Not the right hill to take a loss on. SCOTUS will not uphold this as flag burning is a political statement and protected by freedom of speech.
Ill-advised move.

Ask any veteran that has carried a weapon while the flag of the United States, what he thinks about jail time for disrespecting our flag?
Deportation is a better solution, to a country where you CAN burn their flag.

Censoring expression because someone else can't control himself is the "heckler's veto" beloved by leftists throughout the world. Thankfully the First Amendment protects us from it.

The other problem with this is that Art. II does not give the President power to enact laws, but only to execute laws passed by Congress. The congressionally delegated power to administer certain laws by agency regulations does not apply. I hate flag burning but I love the Constitution more.

As someone else pointed out yesterday, this is a brilliant move on Trump's part. Democrats are currently polling at around a 20% approval rating. Let's try for 15%. Please Democrats, go out and burn some flags publicly and with much outrage. Please. Pretty please?

Simply a trolling action--scrolled by CNN and MSLSD last night during a commercial in the 9-10p slot and both panels were ablaze about this topic. Let's go, fire up the lunatics!

Watch closely as a band of ACLU "chimps" rushes a "free speech" lawsuit to a particular black-robed, cymbal-clapping, DC District Court Ape in 10, 9, 8....

I have no problem with this...years ago...in school...WE were taught respect for the flag...WE couldn't let it drop on the ground...WE couldn't throw it out when it got old....it was taken to the nearest firehouse...and they burned it....to this day...I remember on 9/11 all the American flags hung on doors and fences in my neighborhood....

It is specious for courts to declare that burning the American flag is "speech." That's foolish language, even if was stated in a majority SCOTUS opinion. The Court's been known to be wrong before. Flag burning is not speech--it's burning, done by some masochists who secretly want to be punished. Such firebugs as these are vermin, and deserve to be flogged as if on the HMS Bounty, even if that never happens.

If people receive jail penalties for burning a trans flag, an Israel flag, etc., why then wouldn't burning an Amercan flag suffer any penalties? The other flag holders claim those burning their flags are “inciting violence,” so in my opinion, like President Trump, I believe those burning the American flag are inciting violence against USA. Flags are symbols or icons for deeply held beliefs, and burning them publicly is a statement against the symbolism.

so some believe that the flag is just a symbol and if someone wants to burn it, fine it's just free speech. BUT dont you dare burn the BLM flag, or that stupid GAY flag! That is a crime and can get you up to 15 years in jail. Just ask the guy who is sitting in jail because he burned a gay flag. Tell him he should have burned the American flag. because to some Americans its just a flag.
