After U.S. District Court Judge Paula Xinis issued a ruling that will block U.S. Immigration and Customs Enforcement (ICE) from arresting Kilmar Abrego Garcia, the citizen of El Salvador facing federal human trafficking charges in Tennessee, U.S. Senator Marsha Blackburn called on her colleagues to pass the Judicial Relief Clarification Act (JCRA) of 2025. “An Obama-appointed activist judge issued an order to block ICE from apprehending Kilmar Abrego Garcia upon his release on bail,” wrote Blackburn in a post to the social media platform X. “You can’t make this up. We must pass the Judicial Relief Clarification Act and end this insanity.

Since some of the district judges are ignoring the Supreme Court ruling against nationwide injunctions, either Congress will have to act or Trump will need to force the issue by openly ignoring these absurd injunctions. This can't go on.

Somebody needs to do something this is tiresome and beyond rediculous! Apparently the Supreme Court is useless and has become irrelevent so what is the use of even having it, when lower courts can just do as they please.

1) Don't blame the judges. The Federal and District court system is under the jurisdiction of Congress not the Supreme Court. The Judiciary Act of 1789 established a federal court system with district and circuit courts and the Supreme Court. Congress has to quit pretending they cannot address this issue, stop ceding its authority to the Supreme Court (which it tends to do in politically sticky situations), and deal with it. 2) They should have left Garcia in El Salvador. IMHO, unless there is something happening under the surface that I cannot see, (a long range goal yet to be accomplished through it) this is an unneccessary mess of DOJ's own making.

I suspected that this was the case, and even said so in a recent radio interview. But I have been very reluctant to write about it because I am not a lawyer, so I can only use my common sense and layman's understanding of the law in what must be a very, very complex question. But Trump, who certainly has access to excellent legal advice, has just said that Obama has immunity from prosecution for any crimes he may have committed in conspiring to use falsified intelligence to undermine Trump's presidency, set up a phony impeachment, and perhaps put Trump in jail.
