On Wednesday morning, in a 5-4 emergency decision, the Supreme Court upheld a decision from U.S. District Judge Amir Ali that essentially says that Donald Trump can't withhold $2 billion in USAID money from existing contractors. Chief Justice John Roberts and Justice Amy Coney Barrett sided with the three liberal members of the court. Justices Samuel Alito, Clarence Thomas, Neil Gorsuch, and Brett Kavanaugh voted in favor of Trump, with Justice Alito writing the lengthy dissent that begins with: Does a single district-court judge who likely lacks jurisdiction have the unchecked power to compel the Government of the United States to pay out (and probably lose forever) 2 billion taxpayer

Ignore the Supreme Court's decision. They have no authority to compel the President to pay this money. There is precedent when in 1832 President Andrew Jackson said, "John Marshall has made his decision; now let him enforce it."

I beleive Roberts is fully compromised but Barrett is the poison . I beleive she dispises President Trump. She is ,as they say ,coming into her on now much as O'Connor did. Her arrogance and leftist gullibilty will guide her and destroy the courts cred. Hopefully Trump will get another bite of the apple and put this fraud in the appropiate box for her term.

Time to start fighting back against this travesty of a Supreme Court which no longer follows the Constitution. Begin impeachment proceedings against certain unqualified judges by investigating them for corruption and failure to fulfill their oath to defend and protect the constitution. I guarantee that they are also getting wealthy on their government salaries. The republicans control Congress and can repeal the bill that created the maze of lower district courts and make the Supreme Court take up all of the cases handled by these courts. That alone will tie up the Supreme Court and prevent unconstitutional rulings like this BS.
Lastly, Defy any order like this one which clearly violates the separation of powers clause in the Constitution. It isn't only Congress, especially the communist death democrats who are evil and corrupt, or the Deep Swamp Blob Bureaucracy, but also the Courts which are infested by radical communists. This is all part of our war to take back our Country and Freedoms and we must go on the attack against the Courts, especially the Supreme Court. Fight, Fight, Fight.

One ray of sunshine, Justice Alito: "Does a single district-court judge who likely lacks jurisdiction have the unchecked power to compel the Government of the United States to pay out (and probably lose forever) 2 billion taxpayer dollars? The answer to that question should be an emphatic ‘No,’ but a majority of this Court apparently thinks otherwise. I am stunned."
Perhaps now SCOTUS will have to take up the issue of lesser judges having the power to override POTUS.

When this case is returned to the District Court and the Judge there makes any further rulings, the Trump crew should be able to appeal those rulings and bring the case up through the Appeals Court and back to the Supreme Court once any fraud or other wrongdoing is found. Instead Trump in time should redirect the $2 billion dollars to increase benefit amounts to legitimate social security recipients who would mostly be senior citizens.

I expected this. Those contracts are legally binding and companies - shady or not - forecast their financials based on that revenue. I don't know if State has anything like the Defense Contract Management Agency who might be able to investigate misuse of funds. The fallback position would be to ensure next year's budget is pared way down.

Time for term limits for Supreme Court justices. Try amending via the usual process, but failing that, do it with Article V. I've had my fill of these nincompoops who "grow" to the left once a Republican president gets them appointed to the court. The only reliable remedy to their "growth" is term limits. Dr. Levin suggested 12-18 years in his book "The Liberty Amendments"... A copy of the book should be sent to every state legislator in the country, since they will be the ones running the show in an Article V Convention...

Oh, BTW, I think PDJT should send a $1 billion bill to both Roberts and Barrett. Since the Supremes are so interested in seeing $2 billion get paid out that we don't have, they can cover it from their own pockets.

In this case, I agree with the dissenters. The three branches are Co-equal. Trump has the authority to tell the full court to pound sand. The courts should not inject themselves in this matter.

Who checks the Supreme Court? Withhold the funds anyway; make up any excuse you like. We see that Roberts and Barrett have been bought and paid for. Ignore their behinds; what did they do to biden when he ignored them?

Only Constitutional lawyers and or scholars should be on the SC.
Robert’s is still compromised, as is Kagan and Sotomeyer. I believe the 3 of them are controlled by the same person. And missy/mister Jackson is just a complete unqualified political payback on the court. All 4 should be impeached.

Payment for services rendered is how things are done. If you were the contractor, you would agree.
However, they do have some $$ latitude in determining whether or not services were actually rendered and terms of the contract met. An audit of the contractor and/or proof of services rendered would handle that nicely. Some changes need a sledgehammer. For others, a scalpel is better.

I think the decision is fair and that funds that were previously earmarked should be dispersed. Do I like it? No, but these contracts should be fulfilled because they were promised and people are depending on that funding to clear.
It doesn't mean we have to disperse anything after this, but I do think it is in our interests to honor the current agreements before shutting the fawcets off.

Trump should ask Elon to take a look at the contractors. It generally not difficult to find something a contractor has done to violate the myriad conflicting federal laws and then hold up payment until the violations can be adjudicated.
And maybe ask Kash to see if he can find out if any Supreme Court members are being blackmailed and then either pardon them so they can rule free from coercion or ask them to recuse themselves on or retry any cases where blackmail was used to influence the outcome. Since the demoncrats (oops) are willing to go back to a persons birth to find blackmail material, maybe the FBI should do the same to make sure they are free of any coercion. Were Bob or Amy a little wild in high school? College? A little experimentation maybe? We should probably know.

Now that Republicans have control of the CIA and the FBI, we should be able to determine who is blackmailing CJ Roberts and put a stop to it. Either by having him leave the court or by resolving the problem and prosecuting the blackmailer.

no body did no work for no one; it was 99% grift.

The article states that the $2 billion is for work already done. A lot more than that was cancelled from the USAID budget. I don’t necessarily think that was a bad ruling. The bigger issue is that district court judges have no authority to make nationwide decisions. The SC is hiding from that issue right now but it’s going to eventually have to be addressed. They need to be cornered.

Trump should publicize where every penny goes. If it's hiring personnel in NGOs or paying for salaries in other government or in covert operations that the CIA is calling for.. the public should know. But it on the internet... let everyone see exactly where the $2,000,000,000.00 is going.

There's more to this ruling than meets the eye...as Judge Neopalitano said....the Trump team will delay this for a clearer understanding of the ruling...perhaps Barrett and Roberts can explain their decision to the world...and the Clinton foundation won't get their millions...right away...aww...poor crooked Hillary...she's running out of money...and the Middle East won't be getting their Sesame Street money right away...

It's not over yet.
The crux of this particular case was the USSC to review a TRO, which in general is not reviewable. So the 5-4 vote was arguably more procedural than substantive. However, the USSC will review the substance of the preliminary injunction on the 6th of March. The minority Justices are more than likely chomping at the bit to grant review on appeal...and only four justices are needed grant review.

We are angry, upset, dismayed at a lower court going over and telling the Executive Branch what they cannot do which the Constitution tells them they can do. This cannot stand. We appeal to a higher court. The Court of Heaven.
Lord God, stop this travesty and put order back into our government. Lord, speak to Barrett and Roberts and give them not a moment of rest until they do what is right and reverse their vote.

Enthusiastic yes to #14! The entire federal court structure was created by a
an act of Congress, and can be voted out of existence or transformed by a simple majority vote through an act of Congress. The Constitution explicitly gives Congress the power to establish and destroy these courts and redefine the jurisdiction of other courts.
In fact, the current supreme court was also established by a simple majority vote through an act of Congress. The US Constitution requires a supreme court; it is silent about what the supreme court should look like and how many members it should have. In the past, Congress has passed legislation that changed the number of justices on the supreme court and expanded or contracted it's jurisdiction.
Lastly, US Constitution does not--repeat, not--give the supreme court jurisdiction to review the constitutionality of legislative and executive acts. So-called "judicial review" is an invidious precedent established by the supreme court's own decision in Marbury versus Madison, and it has been implicitly accepted by the other two branches as a matter of convenience.
All of this could be fixed by a simple act of Congress. All that's needed is the will to do so.
So they won't.
