Hours after Arizona’s supreme court declared on Tuesday that a 160-year-old abortion ban is now enforceable, Republicans in the state took a surprising stance for a party that has historically championed abortion restrictions – they denounced the decision.
“This decision cannot stand,” said Matt Gress, a Republican state representative. “I categorically reject rolling back the clock to a time when slavery was still legal and we could lock up women and doctors because of an abortion.” First passed when Arizona was still a territory, the ban only permits abortions to save a patient’s life and does not have exceptions for rape or incest.

My first thought was that this was a political decision by a liberal court to get the baby killers all riled up to vote. Considering their rulings vis the vote stealing cases before it one can only conclude this court does not act on the merits of a case just the politics.

The Arizona court simply stated that a law remains a law, unless overridden (like by the Roe decision) or a new law supersedes it. The Republicans are saying it's time to get a new law together that is more reasonable. If the legislature and Governor agree, that can be done rather quickly, I would think.

This seems like a nothing story. The statute the court struck down that allowed abortions up to 15 weeks conflicts with the 1864 law, and does not explicitly repeal the 1864 law. Arizona can do wha they want, they just need to not be sloppy about drafting laws. Also, people need to realize laws don’t just fade away because they are old.

Guardian is about as politically unbiased as HuffPo. Their reporting on this should be treated as deliberately misleading (or even outright untrue), until passing 2 or 3 levels of critical scrutiny. And even then, questioned on motive.

Isn't Donald Trump being prosecuted by laws that were made after the Civil war?
Aren't the J-6 prisoner kept in prison without bail just like the Southern prisoner from Maryland were during the Civil War/

I'm surprised there was an abortion law in 1864. Having witnessed a few abortions, the thought of an abortion being done in the 1860's is almost unimaginable. The life of the woman was almost as much at risk as the baby, and since they didn't know anything about blood type or transfusions, I'm sure quite a few women lost their lives as a result. This is probably why the ban on abortions in Arizona was put in place in 1864.

If a state has a law on the books, it is the law. You cannot ignore it just because it is old or you disagree with it.

Actually, I thought it was funny. Someone was whining about the 15 week? limit, if I recall, and were told the old law was still on the books.

Charlie Kirk had an interesting take on this yesterday - There is time enough between now and the election for the state legislature to basically "copy" Florida's abortion law, (Or fix the abortion law Doocy signed back in 2022 so that it supersedes the 1864 law) and push it thru to the ballot, so it can be voted on by the people in November, bypassing (the guaranteed veto by) the governors office. It's not the complete abortion ban that strict pro-lifers (like myself) want, but it is politically more able to pass in our current climate.

OMG. PLEASE tell me you guys don't know what happened. The Dems here in AZ are yukking it up BIG TIME. They pulled off an absolute coup---they identified abortion as THE topic to topple the Pubbies and then strolled the State GOP right off a cliff...because of Kari Lake's previous comments they either have to look like they've reversed course or support a civil war era law. Either way they look like idiots. You should just see the CELEBRATING going on---they talked the Republicans into seeing a way to appear headstrong and unshakeable on a very tenuous issue and yup, the Pubbies took the bait hook line and sinker. And they look like idiots.
