Judge Scott McAfee ruled Wednesday that former President Donald Trump and eight other co-defendants can seek review of his decision not to disqualify Fulton County District Attorney Fani Willis. McAfee granted the certificate of immediate review sought by defendants, finding it “of such importance to the case that immediate review should be had.” The decision means defendants can appeal McAfee’s decision, which allowed Willis to stay on the case against Trump after special prosecutor Nathan Wade stepped down, despite finding an “appearance of impropriety” in their actions.

Comments:

The general rule is that you cannot appeal any ruling of a trial judge until the trial is completed, with only a few exceptions, so this is good that Judge McAfee agreed to an exception in this case. The Court of Appeals will not have the same fear of Fulton County voters that intimidated Judge McAfee.

Whoopty Do. Now it goes to the GA court of Appalls with Fulton County in its jurisdiction. And those judges are elected. So guess how this is gonna come out.

They also need to file a motion to dismiss based on selective prosecution. See p. 22 of Judge McAfee's slip opinion. He went out of his way to helpfully preserve the federal question for them. Before doing so, they should read the new groundbreaking case from the Central District of California, United States v. Rundo (https://caselaw.findlaw.com/court/us-dis-crt-c-d-cal-sou-div/115856212.html), in which Judge Cormack Carney called out DOJ for consistently prosecuting the right but not the left for the same or even worse conduct.

#10 - Indeed! We're not all nuts in this state. I'm native born and TK's been here sixty of his 78 years, so he's naturalized. We made a conscious decision when we bought Fort Serenity that we would be staying in California, making our stand for freedom and America here. Let us pray the Appeal Court does the right thing, and uphold the integrity of the law in the State of Georgia.

This Judge is simply doing a CYA move. He knows his original ruling was pure BS. He is hoping the appeal court will do the job he failed to do. OI hope his reelection is toast this guy is a gutless wonder.

You have to hand it to The New York Times. They are as slick as they are deceptive.  A paper once known for afflicting the comfortable in government, they have been on a tear lately, shilling for the overlords who want to run our lives and rig our democracy. (snip) Of course, this being The New York Times, they are lying about everything, not the least of which is what we mean by the "Deep State." The Supreme Court has announced that the bar exam is no longer a requirement for those who aspire to be practicing lawyers. The Bar Licensure Task Force claims that the exam is only minimally effective in measuring competency and noted its unfair barrier to marginalized communities aspiring to practice law, according to the Washington Administrative Office of the Courts.
