All they need is an order to "Stand by to repel invaders." There is no Posse Comitatus Act restriction (use of military for domestic policing duties) on interdicting, repelling, and/or killing foreign invaders. To invade means to enter a country, place or situation in overwhelming numbers in order to take control. That we have in spades and as any existential threat, should be resolved with extreme prejudice.
