Washington — A federal appeals court in Washington found former President Donald Trump is not entitled to broad immunity from federal prosecution, delivering a landmark decision that would allow the criminal case against the former president involving the 2020 presidential election to move forward if the ruling is upheld.
A three-judge panel on the U.S. Court of Appeals for the District of Columbia Circuit said in its opinion Tuesday that it is upholding the decision from a lower court denying him absolute immunity from prosecution. "For the purpose of this criminal case, former President Trump has become citizen Trump

Would we have expected anything different from the DC Circuit?

This case is going to be a legal mine field for Trump and his team. They were raising concerns as to the legality of the plan in e-mails. If not outright admitting is wasn't legal.
THIS is the stuff that had me screaming during the primaries, that once the serious cases starts to hit, he is in real jeopardy. YES, many of the cases are BS. THIS ONE however, yeesh, I wouldn't want my name on the email chain.
And, NO President should have absolute immunity! Just a for instance, "Biden sends out a hit squad (a real one) and starts whacking people, should anyone condone that?

If SCOTUS does not reverse this, then immunity for all federal judges & congress critters needs to be eliminated also. Prosecute away. Follow up with tribunals to hold past presidents accountable for illegal acts committed both home & abroad. /Prison construction to house all the new convicts will be a boon for the economy. /s

If allowed to stand this will irreparably harm the Presidency, governance and the exercise of executive power. It is
a clearly stated (constitutional) principle that only a convicted President can be separated from his executive privilege and treated as a private citizen in matters relating to his official actions. That conviction is through impeachment. This has been tried and failed - twice. But this is a DC court - where justice and democracy go to die. The SCOTUS should step in ASAP before it gets out of hand.

The DC Appeals court is populated with leftist ideologues, not honest judges. This will go to SCOTUS, and Trump will win.

Gee, I seem to remember Hillary and Jill Stein trying to overturn the 2016 election by holding recounts and trying to get members of the Electoral College to illegally flip their votes. When do their trial start?

So, while you're still POTUS, but also running for re-election, your actions related to the campaign are private citizen?
They need to bring out the steps that were taken, particularly by Nancy Pelosi on Jan 6th where she declared an emergency which removed the constitutional process of challenging state electors.

Calling an election was filled with fraud isn't against the law. As usual, Trump was right. Millions of people thought the election was full of fraud. Now after three years of Biteme, and the country circling the drain, not only were the millions of people correct about the amount of fraud, but probably millions more believe it as well.

The Dems' ballot-harvesting activities and count-manipulating actions were immoral, if not illegal. But his efforts to get around the effects by arranging alternate slates of electors outside the electoral process was illegal, too, if not immoral. A classic exemple of the adage that "two wrongs don't make a right."
Watch the Left try to gender-change this into an insurrection to exclude him from ballots this November.

I do hope that Republican AGs and DAs are currently in the process of drawing up multiple indictments for which to prosecute Briben as soon as he leaves the Oval office. Goose, meet Gander.

They're making the "law" up as they go. Same tactic that allowed e. Coli Carroll to bring suit.

Apparently this decision was rendered by three Democrat appointed Judges, would that make any difference in such a politically charged case?

Wonderful. Now we can prosecute Obambi for ordering the murder of a US citizen on foreign soil and two innocent children. Imagine the crimes Slick Willie could e prosecuted for. And Diaper Joe is a target rich environment. And go after Congress as well. And don't forget judges. Make these fascist live by their own rules.

I'm OK with this. I want the case thrown out on lack of merit or Trump found not guilty. No technicalities!
