This judge’s decision without a jury is a TELL as to the judge’s mindset. Any opinion on the value of real estate is exactly that - opinion. Real estate brings what the traffic will bear,

Relying on the assessor's valuation is always incorrect because it is not done for the same purpose as an appraisal for a loan. Also, don't banks have an obligation of due diligence to do their own valuation and not rely on the borrower's? Also, appraisals are statements of opinion. They cannot be false unless it is proven that there was intent to deceive. The judge said no showing of intent required. I think he is wrong in this case.

This can easily be resolved. Let the judge make an offer through some real estate agents to buy the property for $18 million. If he gets a counteroffer of $160 million, he will finally understand what the difference is between an appraisal (opinion) and the actual sale price (fact).

I don't understand where the fraud is. Did Trump overinflate his holdings to borrow money? Then the BANK would file charges and even then if the loan is being paid, they won't care. I can say that my property is worth $$$$ when it is really worth $$, but unless I do that trying to borrow money or sell it, it is just my opinion not fraud.

#5 - as bizarre as this sounds, the trial court level in New York is called "supreme court," which of course makes no sense. The highest court in New York state is called the Court of Appeals.

Some of the first son’s paintings retail for $500,000. If he sells 36 of them for that price, he can buy Mar-a-Lago? He only needs to sell 36!??!!

How much is the judges "Real Estate" portfolio worth?
Or does he rent?
Maybe sublets a rent controlled property?
The real vexing aspect is that he does this as a summary Judgement BEFORE the trial even begins, no avenue to confront the evidence, submit opposition witnesses/documents/data no path to the "right to cross examine".
Even worse...the judge essential SEIZED ALL Trump companies and properties, in NY, as well as the post office in DC(though Trump has already been forced to sell it), the Golf Courses, and NO Trump Family member will be allowed to run any of that. A "Third Party" will be "Gifted control" of all assets/companies and FORCED to cough up at least $250 Million on a short deadline/firesale basis, a 3rd party chosen BY that Judge. "A pound of Flesh"...regardless of precedent, or Justice.

No law says a judge can't misjudge. They often do. In this case, spectacularly. A hobo under the bridge could have made a better ruling, and without using an adding machine. New York hates Trump almost as much as the DNC does.

For clarification, the NYS Supreme Court is the trial court and it's (at the level we're currently at) not an appellate court--the Appellate Division of Supreme Court is. This case was at the motion stage of the proceedings and what this judge did is decide that there was no triable issue of fact left for the court to decide. In essence, he gave the case a bench trial and decided that his opinion was that there were no triable issues left based on his opinion of what the properties were and are worth.
He's set himself up for being overturned by the Appellate Division but he's not worried because even on an expedited schedule for the appeal, the AD will issue a stay pending appeal and it'll be late spring when the case is scheduled for argument.
This is all theater.

Most, if not all state penal codes require proof of the alleged offender's culpable mental state, typically defined in terms of purposely, knowingly, recklessly, and negligently. I don't claim to know New York's Penal Code, but the culpable mental states, are fairly uniform throughout the U.S. Mens rea is the state of mind statutorily required in order to convict a particular defendant of a particular crime. Establishing the mens rea of an offender, in addition to the actus reus (physical elements of the crime) is usually necessary to prove guilt in a criminal trial. Civil trials have different requirements but it does appear that Trump's NY trial included an extra-legal mixing of civil and criminal procedures. Unfortunately, the author fails to provide adequate background information on whether the judge's actions are strictly related to a lawsuit or criminal proceedings. He essentially ruled that Trump is guilty of criminal fraud without the benefit of a criminal trial. Improper, to say the least. Now that Melendez has set a new standard, expect the judge to be paid in gold bars. Bidenomics even affects bribery.

President Trump needs to hire some Realestate agents to determine the real value of Mar-A-Largo...and present it in court to show the judge just how stupid he is....but then perhaps he's on the Epstein flights and has dirty baggage that the rats can use to blackmail him with...there must some reason for his stupidity...or perhaps china's money sent his kids to private schools....

You can tell much by a person's face and by his actions. This judge, Justice Arthur Engoron, has hatred in his face and in his actions. There's not an ounce of unbiased judgment on this judge's decision. He's out to destroy. Who does that sound like? The devil, Jesus said, comes to kill, rob and destroy. I come to give Life and Life abundantly. Arthur Engoron is a destroyer and he is listening to the devil who wants to eliminate President Donald J. Trump in any way possible.
