Opinion: Why Trump’s January 6 defense
is even worse than it seems

Original Article

The best defense former President Donald Trump has against his indictment in Washington for multiple conspiracies to defraud the United States as part of the events of January 6, 2021, hinges on his purportedly sincere belief that he actually won the 2020 election. According to the prosecution, Trump and his co-conspirators attempted to “overturn the legitimate results of the 2020 presidential election by using knowingly false claims of election fraud to obstruct the federal government function by which those results are collected, counted, and certified.”

Comments:

Check this out for an example of the lengths to which a leftist law professor will go to crucify Donald Trump. Of course the biggest problem wth his argument is that in a sane world, even if all the allegations he discusses were true, the duly elected president has done nothing illegal. Lies are protected by the first amendment. Petitioning the government for your grievances is Constantly protected.

Pathetic nonsense. This person sounds a lot like the lawyers arguing the states twisted prattle in the Rittenhouse persecution. The jurors didn't buy that either.

Bull hockey. 1) There was no riot. 2) There were a few antifa thugs and undercover federal agents who broke FOUR windows, and pushed past barricades. 3) Almost all the people there walked in, past Capitol policemen holding the doors for them. At worst, we have trespassing and a few individual cases of relatively minor vandalism. One person stole a laptop. That is a crime....but only for THAT ONE person. Trump did NOTHING whatsoever illegal. He told people to be peaceful and to protest. He didn't incite the crowd, and they didn't riot, and they CERTAINLY didn't start anything remotely like an "insurrection"....no guns, no shooting.....except for the Capitol policeman who shot to death an unarmed woman for trespassing. Any other person who shoots a trespasser and kills them....will go to jail for at least manslaughter. Trump is 100% innocent of any crime related to the events of January.

Remind me if I ever need a lawyer, not to hire this bozo. Or any of his learned students. The only wise advice I saw was that Trump should not take the stand. That's usually a wise move for any defendant in a criminal case. Yes, the prosecution has to prove guilt -- and just saying something is "false" does not make it false. But the persecution does have some cards -- they have a favorable judge trying to rush the defense, who has not had the opportunity to review ALL the material that the persecutors plan to use (and probably find there is much exculplatory evidence that they aren't going to provide), a jury pool that voted 95% against Trump, and a media that runs tripe like this. President Trump and his lawyers would be wise to delay any trial as long as possible -- probably after the 2024 election -- so they could properly prepare for the serious charges (with suspicious evidence, not related to what they are charging him for), and obtain a change of venue to a more favorable locale.

First, who thinks it's in Trump's nature to simply give up when he thinks there's a chance. Second, they were likely hearing all sorts of reports of election issues so he likely felt there was more than just a chance, but that things seemed to suddenly change without a good explanation. Thus, he had a good rationale to investigate to the "nth" degree he could. Third, he knew he was being attacked, and didn't really have a peaceful transfer of power considering they were investigating him while he was a candidate, after he won the election (transition) and throughout his entire Presidency, so had good-faith concern that something more was being done that wasn't on the up and up. Fourth, only due to the J6 event did they change the rules for counting electors, which Pence should easily be able to confirm, AFTER they re-convened that same January 6th evening. Fifth, no one has been charged, including the Proud Boys and Oath Keepers (had never heard of either until this event), with insurrection. A few were convicted of seditious conspiracy.

Folks, like it or not, Joe Biden "won" the 2020 Presidential Election. When the Electoral College votes were counted, yes, he had over 270 and was certified as the winner. And yes, it's very possible that Biden won the election. Let's face it, President Trump won in 2016 by something like 70,000 votes in three states. With about 150 million voters, 70,000 votes is a rounding error. As I said during that election, the Trump team didn't have much they could afford to lose. And our opponents took advantage of every legal, illegal, moral, and immoral advantage they could. Did he win it fairly? That's a debatable point. Very debatable. There are just too many "coincidences" that happened, almost simultaenously, and all fell one direction. If this was the lottery, it would be like winning ten jackpots in a row with the same ticket. Sadly, President Trump and his allies, much like Kari Lake in Arizona, were not offered the opportunity to challenge these results in court. I tend to fall in the "I suspect something fishy, but can't prove it" category. President Trump needs to focus on Make America Great Again Again. Let the courts, press, and Dems relive the 2020 election.

A district judge appointed by Joe Biden has ruled that parents in Montgomery County, Maryland, have no right to opt their children out of the school’s woke LGBTQ curriculum. United States District Judge Deborah L. Boardman ruled against the Muslim-led group of parents who did not want their children exposed to far-left propaganda about sex and gender. The parents sought an injunction before the first day of school on August 28 after the district changed its policies in March to no longer allow parents to opt their children out of being assigned books that advocate pride parades, gender transitioning, and pronoun preferences for kids as young as pre-kindergarten.

The Democrats have an ace in the hole in their relentless war on the Constitution – conservative America’s reverence for the concept of the rule of the law. Only their steadfast commitment to this traditional ideal explains why conservatives are allowing Democrats to flagrantly corrupt our judicial system to destroy their opponents and protect themselves. For all their huffing and puffing, conservatives have effectively taken a let the system play itself out attitude while Democrats nakedly politicize that system through their partisan indictments of former President Trump and their Potemkin Village probes of the Bidens. These are not statements of opinion. These are facts.

All eyes will be on Milwaukee tonight for the first Republican presidential primary debate. Despite more than eight years of brazen attacks on his opponents since riding down the golden escalator to announce his candidacy in 2015, Donald Trump has decided to sit out this debate. Unsurprisingly, the twice-impeached and now four-time indicted ex-president is, first and foremost, a swampy politician who won’t risk getting rhetorically pummeled by one of his challengers....As former Labor Secretary Robert Reich wrote in an essay last month, Bidenomics “is turning out to be the most successful set of economic policies the United States has witnessed in a half-century.”

The real problem with racism in America today is that demand far outstrips supply. Where does the demand come from? Chiefly from our woke elites. It is they who understand that the charge of “racism” is a potent meal ticket and guarantor of institutionalized political power. Accordingly, they have a large stake in perpetuating the reign of racism. In this realm, too, incentives matter. It is also worth noting that many of these elite race cadets are white. Blacks are invited to participate in this theatrical production, but only so long as they play their assigned roles. They must mouth the pieties about “systemic,” i.e., perpetual, incurable racism. CORRECTION*

Beginning in the summer of 2020, when myriad states, legally and illegally, changed their voting rules in a way that removed all safeguards against fraud, it was clear that there might be problems in November. Then, on election night, six major precincts — election outcome–changing precincts — stopped counting votes altogether. When you add in all the other evidence adduced in subsequent weeks showing fraud (including Biden's unbelievably soaring vote count long after the election ended), there was good reason to question the election. Mike Pence has now conceded that he believes he could at least have opened the path to question election fraud.
