After years of flip-flopping, the ATF has issued a rule recharacterizing guns with pistol braces, making millions of currently owned guns subject to federal "short-barrel" rifle registration, together with a $200 tax. The effect of this rule change is particularly potent in Connecticut, where existing laws banning so-called "assault rifles" are immediately triggered. Owners there of handguns with pistol braces cannot merely remove the brace if the weapon has a "forward pistol grip" or "second hand grip"; these guns are effectively rendered instantly illegal due to the fickle federal rule change.

Rightly or wrongly, the National Firearms Act set the definition of an SBR in 1934. When you put a stock on a handgun it becomes short barrel rifle. You can call it a "forearm brace" all you want, but it's a stock. Virtually anyone you see shooting one one of these equipped with a brace, almost always braces it against their shoulder, just like a rifle. And that's why people bought them. To circumvent the law and avoid the cost and registration involved with SBRs. "It's not an SBR, it's a handgun with a brace." Wink, wink. They can deny it all they want but that's why they bought them. It shouldn't be a surprise that a deliberate workaround is going to attract attention. Low hanging fruit is going to get picked.

As a resident of CT, who does not own such an 'other' but does legally own a handgun, all I can think about is: What's next?

I am comfortable with being a law breaker in a lawless society. Never volunteer information about what you have in your house, or there will one day be someone at your door to collect your possessions.

There's a simple fix for overreach like this. Have congress pass a law that no un-elected bureaucrats/agencies are allowed to pass laws. This would go for the FDA, CDC, ATF, EPA and any other alphabet agency. It's not a perfect solution but at least it would take the decisions out of the hands of people/agencies with no accountability to the people.

Remove the brace, presto-chango, and magically it's back to being a pistol. I know of people who have purchased the necessary plain buffer tubes, ready to "alter" their pistols which ATF now calls rifles, back into rifles, according to the ATF's illegal, stupid law making. I think this clearly falls under what the court ruled in the recent West Virginia vs EPA case, and that ATF does NOT have the authority to make laws like this. We need a case to run up to the federal courts, and cite the West Virginia vs EPA case and shut down the ATF. Re #2, the ATF sent at least two written letters saying that braces "are not stocks" and a later clarifying letter, saying that "incidental contact with the shoulder when being used" did NOT make the gun a short barreled rifle. ATF had this in writing, very clear for YEARS, which is why people purchased guns in this configuration - because they were explicitly said

I trust that nearly all AT readers know who Joseph diGenova and Victoria Toensing are. I have long admired both of them as brilliant and tireless conservative thinkers who also happen to be legendarily effective lawyers, usually fighting for conservative causes. Joe and Victoria have been targeted by Merrick Garland’s Department of Justice (details below), and despite being lawyers themselves, need expensive legal and support work to help them fight back. Last week, Tucker Carlson had a brief segment about the leaked FBI memo recommending surveillance of traditional Catholics as potential domestic terrorists. The contents of the memo became widely known only because of a fearless FBI whistleblower assigned to the relatively small Richmond, Va. district office. (snip) Michael Matt's media organization is the best known of the so-called traditional Catholic domestic "terrorist" groups named on the SPLC's list. You can tell that the progs who have monopolized late night comedy are scared out of their wits by the triumph of Gutfeld!, the Fox News competitor that has grabbed ratings leadership, despite a visibly smaller production budget and distribution lacking free broadcast TV stations. When it was announced that a promo video for the show would air during the Super Bowl, heads figuratively exploded. They know that exposing the show to the gigantic Super Bowl audience, many of whom had never heard of it, would inevitably drive sampling, and that some of the new viewers would stay with the show, further driving down their ratings.

A new and increasingly popular Twitter hashtag is “#diedsuddenly” in response to a surge of sudden unexplained deaths among mostly young and healthy individuals, including athletes, occurring over the past 2 years. In 2015 in China, an American friend “Showman” (my nickname for him, similar to his real name), a self-styled expert on Russia, was always telling us fellow expats about how Putin had done so much for Russia (snip) I first arrived in Russia in 1994. I was shocked at the filth, poverty, and violence. The Biden family (as in crime family) legal problems are beginning to converge in an interesting way. It may be the formation of a perfect political storm. Objective observers (which excludes the MSM) recognize that the Biden clan has had some shady financial dealings. With recent events, the evidence is becoming undeniable. As criminals often do, one of the co-conspirators may need to turn on the other to cover his tail. A woman accidentally ran over a man suspected of trying to steal her truck's catalytic converter in the Los Angeles suburb of Palmdale Tuesday evening, CBS Los Angeles reports. The announcement by President Trump with his intent to visit East Palestine next Wednesday, followed moments later by a reversal announcement from FEMA stating they will now offer support to East Palestine, do not seem coincidental. The Biden administration, including the EPA, FEMA and Transporation Secretary, was likely very worried about the optics of getting blasted by President Trump very visibly next week for their lack of urgency and concern.
