President Joe Biden met with Senate Judiciary leaders on Tuesday, reminding them that the United States Constitution was “always evolving” in his public remarks at the meeting.
“You know there’s always a renewed national debate every time we nominate, any president nominates a justice, because the Constitution is always evolving slightly,” Biden said, referring to his upcoming choice of a nominee to replace the retiring Justice Stephen Breyer on the Supreme Court.

Therein lies the problem...Asshats like FJB believe the Constitution is not a Constitution but a vessel of social change, it is whatever we say it is today. Just another reason why such incompetence should never be accommodated, but repudiated!

To the poster, good analogy, of an "evolving lease agreement". If you have seen the Constitution in the Archives Building in D.C., it is handwritten on pieces of parchment, it is not breathing, it is not moving, it is not "evolving", and the words say what they said when it was written over 200 years ago.

There's that word "evolve" again. Dems use it everytime they want to take a position that they have condemned in the past.

Unfortunately, judicial interpretation is politics and this is subject to change, like the weather. There is a thoughtful process for evolving the Constitution and that is the amendment process. There are 27 amendments.

Democrats have always viewed the Constitution as an impediment; and when they talk of it evolving, they really mean its extinction. Be careful with code. Failure to close it properly distorts the remainder of the thread. Next time Reply will be deleted. Staff

No, the democrat communists just refuse to follow it as written. Bending the rules aka cheating is the only game democrats play. Same as a small child who changes the chutes and ladders rules as the game progresses so they can win. Think like a child and you can usually predict Pelosi and Schumer’s next move.

Actually there is a mechanism for the constitution to evolve. The mechanism is constitutional amendments. It is the basic contract for the USA and any changes to the constitution not conforming to the terms of the constitution itself are illegal.

Democrats have always insisted the Constitution evolves. If you meet one over a game of Monopoly, they'll insist on being the banker, and evolve those rules, too.
However, you'll find the 'Evolved' rules only ever work in their favor.

Breyer referred to our great nation and constitution as an experiment. Don't let the door hit you on your way out. We need representative that follow the words, not the wind.

Oh Joe please accept my offer to debate that publicly. Our willingness to abide by the constitution has evolved in direct violation of it. By design it does not evolve but changes in steps via the amendment process. What you have seen Joe, that makes you think the constitution evolves, is precisely what half of the country is profoundly disturbed by and pondering a transition of expressing our objections from a 1st amendment mode down to the next one in line. Please have one of your younger advisors perform the math for you.

The Constitution does not evolve, its wise words are unaffected by time. Neither does Joe Biden who remains at the level of a Rhesus macaque on the Bell Curve. My apologies to the monkeys.

These kind of utterances have one purpose only. How to get political advantage/power by illegally circumventing the Constitution. The Founding Fathers were not unaware that the environment will evolve and change. They made two provisions for it. One they reserved only enumerated powers for the Federal Government leaving residual authority to the People and the States. Two, they put in provisions to change the Constitution through Amendments. There have been twenty five of them. What Joe Dementia said is simply admitting that they don't have the support to make the change legally.

FJB like the rest of the leftist wingnuts have never read the Constitution or know what it is about. In an oath of office, they swear to uphold it, they lie. The left always yells democracy not knowing we are a Constitutional Republic the democracy is only the right/freedom to vote in your government. Joe Biden is an ignorant slug. FJB

The basic truth is not evolving. The Constitution took in mind the tendency of those in power to be corrupt. It has checks and balance to avoid this. The Democrats are basically fascists and want total control and so their goal is to systematically destroy the code to their evil ends.

The Constitution is a restraint on power through the written rule implemented through checks and balances. If a regime can simply interpret those rules to its liking, unchecked, then there is no restraint at all. This statement is a direct assault on the Constitution I swore to support and defend. And if it’s true then we have already failed it.

That the Constitution is a living document has always been the leftist reason whenever they want to change something that gives them more power. The Constitution is a set of rules by which the federal government is supposed to adhere to. At this point, it can only be changed if 37 states agree to make a change, and that's extremely difficult to do. Which is exactly what the founding fathers intended.

To Biden the US Constitution actually can only evolve in ways that the leftist, progressive, or socialist Democrats and their appointed Judges say the Constitution should evolve.

“The Constitution is a charter of negative liberties. It says what the states can't do to you. Says what the federal government can't do to you but doesn't say what the federal government or state government must do on your behalf."

I wonder if they will think the Constitution is 'evolving' when/if the Supreme Court throws out abortion on demand.

No. Absolutely false. A LIE.
The Constitution is rigidly fixed, unchanging - except for those instances when the VERY difficult process of amending the Constitution are carried out.

The words in the Constitution do not change except by the Amendments. However, interpretations of the intentions of the Founding Fathers' have changed hundreds of times, often by nuance in Supreme Court opinions. In effect the Constitution has been "changed" far more by these opinions than by the Amendments. Once in a while such an opinion swung SLIGHTLY to the right, but far more often to the left by the numbers of left leaning opinions and by the degree of the leftward swing. This trend accelerated during the FDR years and went into high gear during the so-called "Earl Warren Court." President Eisenhower said the worst decision he made as President was nominating Warren to the Court.

In 227 years, there have been 27 amendments ratified. These are the constitutionally legal changes. During that time there have been numerous attempts to change the interpretation of the constitution to circumvent the meaning of the Constitution to push a political agenda. These are NOT legal, but some have succeeded! These are described as penumbras and emanations which is double-talk for "We made it up." This is why it is important to put strict Constitutionalists on the Supreme Court. Even strict Constitutionalists do not always agree, but at least they make an attempt to give an honest interpretation

In order to pass an amendment to the Constitution, 2/3 of the states (50) need to pass it, which would be 34, not 37!!

My mistake: 38 states are REQUIRED to pass a Constitutional Amendment. Sorry.

Didn't he cheat or plagiarize in law school? The Constitution is a legal document. Imagine telling your landlord your lease is evolving and you will be paying less.
