Armed Texas homeowners are no joke.
During his final day on Earth, a home invader was taught one final lesson that could have added decades onto his life: Don’t mess with a Second Amendment patriot in Texas.
Had this particular thug been schooled on the God-given constitutional rights bestowed on every American citizen, perhaps he would have thought twice about bursting into a Texan’s home and pointing a gun in the homeowner’s face.
However, in a moment of true southern hospitality, the homeowner felt obliged to teach his unexpected guest how the Second Amendment works.

I doubt that there is any state in the U.S. that would not allow you to defend yourself with a gun when someone [points a gun at you.

Well done! Dropped what is in his hand, left hand lifts the shirt, smooth draw from appendix position, good shooting position, and aiming carefully as he is moving backwards, creating space to move, and preventing the bad guy from getting to him. Bullets travel the 20 feet just fine, don't let them get too close. If you are a decent shot, they probably are not, distance is your friend. Even an incompetent thug is likely to hit you at 3-4 feet distance.
The bad guy immediately recognizes he has has had "a tragic failure of the victim selection process". Apparently, someone was in the passenger seat, must have reached over for the gas pedal and started getting out of there.
The best news is that the good guy had practiced enough, and had selected an effective caliber and ammunition to put effective hits on target under great stress and time pressure. And the violent criminal is no longer a threat to anyone.
All in all, an excellent job by the good guy.
And as for needing the permit....assuming he is on his own driveway, most places allow you to have your gun on your own property, even without a carry permit. But having the permit is best practice, for sure.

The homeowner not only saved his life but saved the taxpayers of San Antonio and Texas the expense of boarding the perp in a Texas jail. The perp in his lust for the taxpayers property was taught that Mr. Colt is the true enforcer of equity when it comes to life or death. Because of the dearth of District Attorneys that have any sense of true law and order the rest of the nation should take notice and adopt constitutional carry for its citizens. The current wild wild west would become the land of the Peacemakers - Colt Smith and Wesson.

Thanks for posting. Good explanation of Texas law regarding use of force in defense of property (and the differences between Texas law and that of other states.)
A very appropriate follow-up for the discussion which occurred here, last week, regarding a somewhat similar incident.

People should not need to remain on constant high alert against sudden attacks, even in our own yards, because our broke governments can't or won't keep dangerous people off the streets. Did the wannabe gangster decide on a whim to do an armed robbery like this? Of course not; he built up to it, probably with a huge list of unpunished crimes as a juvenile.

These articles and their headlines by USA Supreme are a bit misleading in that they keep mentioning "2nd Amendment rights," which involve the keeping and bearing of arms but in all of their examples, it is the use of deadly force that is being shown or touted. The use of deadly force is in most instances regulated by the state in which an incident occurs. This article correctly outlines the provisions and limitations in Texas for when deadly force is justified or conversely, the use of force but not deadly force. When I attended my first police academy to become a Texas Peace Officer, I was somewhat taken aback by the Texas Penal Code Chapter 9 provision allowing deadly force against someone committing criminal mischief in the night. My instructor dated that provision back to post Civil War Texas, when criminal mischief in the night often involved rustlers tearing down fences in order to steal livestock or it may have involved racial-based mischief intended to scare someone off of their land or out of their home. The question of someone wrapping another person's house or turning on a water hose and letting it run was brought up by a student, as those type of incidents can fall under the criminal mischief category but seems unreasonable that such an act justifies the use of deadly force. The instructor had no one-size-fits-all answer but stated that each case would be investigated and adjudicated based on the facts and circumstances of the incident and that a homeowner must be able to articulate the need to use deadly force, which will be weighed by a jury if the circumstances are not obvious enough to apply an affirmative defense to prosecution, which is defined in the Texas Code of Criminal Procedure (CCP). It one meets the requirements of an affirmative defense to prosecution, they will not be forced to defend their actions in court, as there will be no prosecution or trial.

I was an instructor for CCW permits for a few years, still occasionally teach pistol classes, but didn't keep up my certification for the CCW classes, it got too difficult to find range time to teach. Big schools crowded out the individual instructors by locking up all the range time a year in advance.
In any case, Kansas has some laws specifically permitting you to use deadly force against someone who is on your property and refuses to leave, of in your home, and the same. And another says you can use force to defend property. HOWEVER, I very clearly warned my students that they will be judged by what is, in Kansas, called "the reasonable man standard". today's suburban "reasonable man" is going to be very likely to vote to convict even if the law says that the shooting was legal, but if there was no clear risk of personal or another person's great bodily harm.
It is more important to understand how the laws will be implimented rather than just what the black and white words say. Like that "night mischief" - there better be a story there that a reasonable man can get comfortable with supporting as a jury member.
This driveway armed attack is clearly valid self defense and the video as a 'witness' is pretty certain that no charges will even be filed.
And in violent areas, the whole "reasonable man" viewpoint can shift. In Miami in the 80s with a wave of breakins and shoot outs....people got so sick of the crime that no jury would convict any "good guy" no matter how much he may have "colored outside of the lines". It got to "bad guy is dead".....the jury pretty much didn't care at all how that happened, they would not convict a "good guy", and the prosecutors just stopped even indicting any basic honest citizen for even pretty egregious over steps. like shooting a fleeing, unarmed burglar in the back as he runs away across your yard.
Know what standards you will be held to, and be clear on the rules that define the exception of "self-defense" because ALL fatal shootings are homicides. You better be in the legal exception zone, as this homeowner clearly was.

Re #2: The driver of the white car was presumably aware that his passenger was committing an armed robbery. (The video confirms that 100%!) Since the armed robber died in the exchange of gunfire with the homeowner, the driver is guilty of felony murder.The robber got out of the car and immediately had his gun up and pointed at the intended victim. If the homeowner had not been ready to draw with a round chambered, and return fire instantly, this encounter would have turned out tragically for him. The bad guy always gets to choose the time of the attack. This Texan was ready. And the bad guy's criminal career ends with a few warm Gold Dots tickling his innards. You pays your money and you takes your chance.
Just this past week I saw a video of an armed robbery in South Africa in which the armed defender of an armored car did not have his pistol ready to fire, and frantically tried to rack the slide and get his gun hot. He got shot in the head twice at point black range.

A little searching finds that this video is misattributed to Texas.
This first showed up as occurring in South Africa. That explains the car moving off and the shooter getting out of the left front door. In South Africa, the driver position is on the right side, so the shooter was a passenger.
Still, a superb job of self defense, where ever it happened.

The crook was definitely in the wrong state! The shooting was justified as the man had a permit for the weapon too!
