There were a lot of head-smacking moments during oral arguments before the Supreme Court regarding Joe Biden’s OSHA vaccine mandate for companies with more than 100 employees. Even though I know the left wing of the court is packed with totalitarians, it always takes my breath away to hear them opine about how the government should be allowed to exercise almost unlimited power over Americans, and their cavalier attitude about the rights of individuals. What I did not expect to hear was Ohio Solicitor General Ben Flowers—a Republican appointee—arguing before the court that the state essentially has unlimited power to force individuals to take a vaccination.

I wonder how the leftist vegans who are pro-vaccine would feel if the government forced them to eat steak every day to help end a pandemic… and if the government told them they have to eat it to keep their job so they can feed their kids. Would they accept it and devour cows everyday? Or would they fight it and say it’s personal choice?

I want to see the wording in the Constitution or in any state laws that say forced vaccines are legal. Mr flowers should stick to gardening.

Biden did not correct himself after saying “voter fraud organization,” nor did the hosts attempt to correct or clarify his statement.

What do you expect from an appointed AG by a democrat governor. Mike DeWine is NO republican, he is democrat through and through. He only ran as a republican. Primary this troll.

^^Having now read what actually was said, Flowers was talking about state powers. As the article says, hopefully he meant by act of the state legislature,which would be answerable to the voters. I don't see what that has to do with the issue before the Court, which is whether the President/federal bureaucracy has the power to mandate vaccinations at private businesses under OSHA. I'm pretty sure the Court is going to say he doesn't.

Mr. Flowers was BY FAR the best advocate among the attorneys who engaged in oral arguments yesterday, although he slightly missed a bull's eye when he opined that Ohio CURRENTLY has the requisite authority to mandate that all individuals in Ohio must be vaccinated against COVID. He was dispelling the unstated assumption held the liberal justices that only OSHA has such power, but he also unconditionally asserted that currently Congress has NOT delegated such authority to OSHA.
Irrespective of Ohio's current authority to mandate vaccinations, it's legally possible that states can be delegated such power depending on the severity of a given virus, such as Ebola, which is reported to have a death rate between 60 to 65 percent.**
Statutes that delegate these powers to governments should (but far too often do not) specify clear and precise standards, as ambigous standards allow government agencies to exceed their delegated powers as OSHA has done in spades regarding its COVID mandates.
Thankfully the Supreme Court is going to stay the OSHA mandate. Hopefully the Court's final opinion will be a broad ruling that will slow down the (dangerous) expanding federal government's Adminiistrative State.

I am certain that the state has the power to force me to be vaccinated. Not the right, but the power. Only individuals have rights, governments have powers. It is a crucial distinction. I am also certain that, eventually, government agents will inject me with that poison. I even know exactly when it will happen. Right after I lose the gunfight. I will not die alone.
