The Sixth Circuit Court of Appeals upheld the Biden administration’s employer vaccine mandate on Friday. By overturning the 5th Circuit Court’s stay of Biden’s order, the higher court allowed the mandate to go back into effect, but future litigation by the plaintiffs is pending. In the 2-1 ruling, Julia Gibbons, an appointee of former president Bush, concurred with the opinion of Jane Stranch, an appointee of former president Obama. The outlier judge who dissented was Joan Larsen, an appointee of former president Trump. “The harm to the Government and the public interest outweighs any irreparable injury to the individual Petitioners who may be subject to a vaccination policy

The 6th Circuit cannot overrule the 5th Circuit. We now have conflict between Circuits. Next Step: Supreme Court. Result: Mandate declared illegal as it's beyond power delegated to OSHA.

Re #3. There was some "consolidation of cases" which selected the Sixth circuit (probably after getting an agreement by phone to support Traitor Joe) as the circuit to handle "all" these cases. I think that this now goes to the Supremes for a review. Kavanaugh is the justice who reviews the cases for SCOTUS for the Sixth Circuit, although any and all justices can review any cases that they care to.

Pfizer and BioNTech announced on Friday that the companies will modify a clinical trial for their coronavirus vaccine in young children, after a two-dose regimen did not produce a sufficient immune response in children ages 2, 3, and 4. The companies said that “no safety concerns were identified” in the trial, and that participants age 2-4 will be given a third vaccine dose two months after their second dose. Alan Lowenthal (D-CA). Lowenthal is the 20th Democrat who will be retiring or otherwise moving on at the end of this term.
