A federal judge has overturned California´s three-decade-old ban on assault weapons, ruling that it violates the constitutional right to bear arms.U.S. District Judge Roger Benitez of San Diego ruled Friday that the state´s definition of illegal military-style rifles unlawfully deprives law-abiding Californians of weapons commonly allowed in most other states.He handed down the two page ruling in response to a lawsuit filed against the State of California by James Miller, Patrick Russ, Ryan Peterson and the the San Diego County Gun Owners Political Action Committee.

So what about all the businesses and individuals who lost money, opportunity and in some cases, their freedom because the AR-15 was “illegal”?
Shouldn’t they get “reparations” from an oppressive government?

THE SCOTUS has been steadily unraveling the anti-gun agenda. First it was the Heller decision which overturned the DC ban on having guns in your home, and having them fully assembled and ready to use for self defense. That was a very important 'removal' of a whole class of anti-gun laws.
And not long after, there was the city of Chicago vs MacDonald case which held that the 'right to keep and bear arms' was an individual right, and had no limiting requirement to be a part of a militia. THAT was huge, because while up until about the 1950s this had been universally ASSUMED to be the case, since then there had been steady efforts to try to narrow and confine the 2nd Amendment and argue that it only applied to the National Guard and had no action for individuals. A BS arguement, and the MacDonald case killed that view, and moved the needle back to the clear reading of the Amendment.
This ruling builds on both Heller and MacDonald, and may be a great step forward to eliminate the whole concept of outlawing classes of weapons. But you can bet that Cali will put a maximum effort into overturning this ruling. Watch for a request for a 3-judge panel and if they lose that, I predict that they'll ask for an enbanc review by the entire 9th Circus.

However a long time ago, a great football coach once said, Winning isn't everything ... It's the only thing.
Gracias, to Judge Roger Benitez of San Diego. This proves there is life in California and to Justice in the United States of America. And is the reason why we will continue to fight for our freedoms against the enemy within.
This week, we turned a corner in that fight. Not only on the gun issue in CA, but also, on the Fauci revelation, on the push back from several states on the lockdown, on Republican governors making good decisions, on the recent supreme court ruling on Abortion, and especially on the Audit in AZ being the role model for other states to follow. To all the skeptics and naysayers out there, we are winning this battle to take back our country by all the people on the ground who ready, willing and able to take the necessary steps to stand up and fight for our values.

Chances are this case will eventually hit the Supreme Court after the 9th Circus Court of Appeals in San Francisco takes their shot.
