The Abiding Shame of
'Packing' the Supreme Court

Original Article

In 2005, then-Senator Joe Biden (D-DE) delivered a Senate floor speech about President Franklin Delano Roosevelt's doomed 1937 plan to "pack" the U.S. Supreme Court. FDR's plan would have permitted him to add six justices, immediately securing a pro-New Deal judicial majority. But "in an act of great courage, Roosevelt's own party stood up against this institutional power grab," Biden recounted 16 years ago. "They did not agree with the judicial activism of the Supreme Court, but they believed that Roosevelt was wrong to seek to defy established traditions as a way of stopping that activism."

Comments:

I would not have expected Newsweek to publish an opinion piece like this. It’s excellent.

The Left does not like rules. It wants what it wants. No matter that those "rules" or lack of them has resulted in legal baby-killing. The Left has forgotten History. It used to be that Kings and Queens had absolute power, and whatever the Royal wanted, he got. Then cam the Magna Carta and Parliament, and (gasp) the Constitution of the United States. But the Constitution, as George Washing said) will not stand up in a culture that has disposed of God. Oops! I think i mentioned the clue to correcting the problem.

Amazing to see this in Newsweak, but a great quote from the Senate of FDR's time, intending to echo down the ages. "Let us of the Seventy-fifth Congress, in words that will never be disregarded by any succeeding Congress, declare that we would rather have an independent Court, a fearless Court, a Court that will dare to announce its honest opinions in what it believes to be the defense of the liberties of the people, than a Court that, out of fear or sense of obligation to the appointing power, or factional passion, approves any measure we may enact. We are not the judges of the judges. We are not above the Constitution." And Traitor Joe was against this just a few years ago, and now, in his addled, ultra partisan state, he's on the wrong side of this, too.

And notice that the quote in #2 is pretty directly calling out Spineless Roberts for his cowardly actions "... out of fear or sense of obligation to the appointing power," Kind of aimed directly at the heart of Dread Coward Roberts, isn't it. From the range of 84 years, the 75th Congress scored a bullseye on Robert's cowardice.

Even more shameful is the reality that law school nowadays is populated by leftist teachers and impressionable children students. There are ever fewer judges characterized by judicial restraint and faithfulness to our Constitution. So we are left with judges at EVERY level who pretend to be conservative but like Chief Justice Roberts fail the tests of actual cases when such are brought before the courts.

All of this stuff isn't about packing the Court, it is about instilling fear about packing the Court. It is designed to be a Howitzer aimed at Roberts' fragile hold of the Court.

The rats cannot compete on a level playing field. Biden, the FRAUD, needs to be removed, along with all who claim to be his administration. Hopefully, there is a Federal Facility near DC that will "hold" his entire fraudulent staff prior to their trials and their just rewards...

Shamefull??? Not my first choice of descriptors. Is there any doubt that if they are successful that the media won't, with Great fanfare, praise and celebration declare it the best thing since sliced bread to save the democracy. If one wants to expand the court, do it by adding a justice for every new president until your magic number is reached. Just adding 4 for the most liberal president to appoint is partisanship at its absolute worst.

The federal judiciary is an un-elected, un-accountable political cabal, an enemy of the Constitution and of the American people. It needs to go.

Rep. Burgess Owens, R-Utah, called out the Salt Lake Tribune for "woke racism" after the paper published a "pathetic" editorial cartoon comparing him to the Ku Klux Klan that has also irked fellow Utah Republican lawmakers. The cartoon by longtime satirist Pat Bagley compared rhetoric by Owens about migrants crossing the southern border to comments made by the Ku Klux Klan 70 years ago. "The @sltrib and @Patbagley compare me to the KKK, the radical hate group that terrorized me in my youth, because I am one of many sounding the alarm of the trauma being faced by women and children crossing the border. This is pathetic," Owens tweeted

Facebook has had a bad month and, having lost the data of 533 million users, new revelations may just make the social media giant’s 2.8 billion active users think about calling it quits. The revelations come from two very different sources: a university student and a prominent UK newspaper, but both are likely to significantly undermine trust in the social network. The first comes from a viral thread posted by student Zamaan Qureshi: “So I decided to download my Facebook data after learning I was a part of the 533m breach,” he explained. “Clicked on a folder called “your_off_facebook_activity” and was unsurprised to learn that Facebook is following me  CORRECTION*

Project Veritas continued to cause headaches for CNN on Thursday when it published another secretly recorded video featuring network technical director Charles Chester discussing how his employer manipulates coverage to fit its liberal agenda. "I was trying to do some research on, like, the Asian hate, like the people are getting attacked and whatnot. A bunch of Black men have been attacking Asians. I’m like ‘What are you doing? Like, we are trying to help BLM,’" Chester said in the video. Chester noted that "conservatives" would pounce if it was reported that Black people were the ones committing hate crimes because it wouldn’t coincide with the Black Lives Matter movement.

The House Select Subcommittee on the Coronavirus held a hearing Thursday titled, "Reaching the Light at the End of the Tunnel: Ending COVID-19," but it erupted into shouting match when Rep. Jim Jordan, R-Ohio, pressed Dr. Anthony Fauci on when that end might become a reality in terms of restrictions being lifted. Jordan got right to the point, noting that Fauci had recently written that it is not yet the time to cease taking precautionary measures such as social distancing, avoiding gatherings, and wearing face masks. "When is the time?" Jordan asked. "When do Americans get their freedom back?"

A group of Democrats Thursday formally launched a legislative effort to pack the Supreme Court by adding four new justices, in a move that was hailed by progressive activists but quickly met with fierce GOP opposition and skepticism by Democratic leadership. Sen. Ed Markey, D-Mass., along with House Judiciary Committee Chairman Jerrold Nadler, D-N.Y., and Judiciary Committee members Mondaire Jones, D-N.Y., and Hank Johnson, D-Ga., stood outside the Supreme Court Thursday to announce their new legislation to expand the high court from 9 to 13 justices. They said the far-right has hijacked the court thanks to "norm-breaking" moves by Senate Leader Mitch McConnell

Jerry Nadler, D-N.Y., Hank Johnson, D-Ga., and Mondaire Jones, D-N.Y., will hold a press conference on Thursday to introduce the proposal on the steps of the Supreme Court. Given their control of the White House and the Senate, the legislation could allow them to supersede the current conservative majority by "packing" the Court with liberal justices.

Ohio Republican Rep. Jordan made the comment on "Sunday Morning Futures" during an exclusive interview with host Maria Bartiromo following a recent trip to the U.S. southern border where he toured a migrant facility in Donna, Texas. Bartiromo noted that he and the group of lawmakers he toured the facility with were barred from taking any photographs and when they asked for written permission to film "they were told by Biden's handlers it's a moot point."

On Friday, Japanese Prime Minister Joshihide Suga became the first world leader to visit the Biden White House. These visits help set the tone for an administration. That being the case, the new administration’s tone is inept and rude. Biden was also absent for the first part of it, leaving an awkward Kamala Harris to trash the U.S. for gun violence before turning to welcome Suga. When Biden took over, things went downhill. (snip) Normally, when a foreign head of state arrives, the President gives him or her a formal greeting. This time, however, the President was nowhere to be found.

President Obama was well known for his diplomatic blunders, stumbles and curt demeanor with many foreign dignitaries including Queen Elizabeth II. Unsurprisingly it appears the JoeBama administration is picking up right where Obama left off. Japanese Prime Minister Joshihide Suga was the first world leader to visit the White House since Biden’s installation, and the poor form began with no-one greeting the head of the Japanese government upon arrival. There was a prolonged ammunition shortage during the Obama administration. I got through that one because a Power Line reader lined me up with a dealer in West Virginia who seemed to have an endless supply of 9 mm. and .22LR rounds. Over the last year, another ammo shortage has struck, caused in part by an influx of new gun buyers who are responding to rising crime rates, attacks on law enforcement, and the election of Joe Biden. As with most shortages, it has been accentuated by hoarding: whenever a shooter saw boxes of a popular caliber on the shelves, he would buy them all. For quite a while
