Judge Aileen Cannon issued a jury instruction order in Jack Smith’s classified documents case and the leftist legal analysts are going apocalyptic.
Cannon gave two options for jury instructions.
The first option:
In a prosecution of a former president for allegedly retaining documents in violation of 18 U.S.C. § 793(e), a jury is permitted to examine a record retained by a former president in his/her personal possession at the end of his/her presidency and make a factual finding as to whether the government has proven beyond a reasonable doubt that it is personal or presidential using the definitions set forth in the Presidential Records Act (PRA).

As past president, Trump is entitled to any classified document. Obama has millions of them in his ugly library. Clinton and Sandy Burger hauled them out of the white house hand over fist. Political cartoons made fun of Burger, showing him with classified documents stuffed down his pants, his shirt, etc. Everyone had a good laugh.

No doubt, the leftist hacks wanted jury instructions on the line of "Donald Trump had no right to any presidential records. If you find that he kept one single record from his days in the White House, you must find him guilty and as a penalty be summarily hanged from the yardarm, because Orange Man bad."

The law is clear. He can possess ANY document that he chooses, and he can, without ANY requirement for any other person or persons' approval, declassify ANY document.
The charges are complete hogwash.

Re #1, Burger was sent to steal documents from the National Archives that would have incriminated Clinton.
Best guesses are that there were some notations on a document in BillyJeff's handwriting that either said "don't bother with Bin Laden" or perhaps admitted to the Flight 800 coverup and fraud.

Well finally a fair judge, so let the LEFT melt. I am sooo sick of the Left and their dirty tricks, and the criminal tactics they use to smear and destroy people who are in oposition to their thinking, which in most cases is warped and rediculous. The Left and Joe Biden have turned this country into something unrecognizable. You can't trust the government, if you ever could, but for sure not now. I hope Trump comes out of all this OK, but what they are doing to this man, out of pure hatred is disgraceful. Lettica James and Jack Smith, and let's not forget Fannie, and that little crap judge Eragon or whatever his name is, they can all eat dirt and go to hades, asap!

Yes, he pilfered and smuggled out irreplaceable handwritten notes from the National Archives. All as a CYA for Sick Willie. They called him 'Sandy Burglar' and it's Berger, wasn't it?

The leftist nitwits "melting down" over Judge Cannon's instructions are the same ones who think that Sloppy Joe as a senator and vice president was allowed to have boxes of classified documents in several unsecure locations. Including his home garage.

I'm sure they all will agree, then, that the civil judgements in New York against Trump were also "stacked" against him and violate the excessive fine parts of the 8th amendment.

So, it seems like Judge Cannon is merely informing the jury what the law actually says and what Donald Trump’s defense lawyers are saying. The Presidential Records Act provides the President the sole authority to determine which records are personal and which should be sent to the National Archives.
The Judge also points out that the PRA does not even provide guidelines for a President to make those determinations; therefore, it seems that no laws have been broken. There is hope that this case will be thrown out and Jack Smith will cry.

The left is trying to make the Commander in Chief a mere vassal of the "Executive Bureaucracy." If someone in the National Archives says a former President can have it, then they can, and if not, '\Katy bar the door!'
The way to test JackAss's legal theory on this is to subpoena ALL former White House records from the Barack Obama Lie-brary (no advance warning to hide things either!) and see how compliant the 'Magic Negro' is with these modern definitions of the PRA.

Biden sent 1850boxes of his "Senate records" to the Biden center at the University of Delaware, rather than the Archives, where they are to remain sealed until "2Years after he leaves any public office" He did something similar with his "Vice Presidential records", also not sent to the Archives, or even the Obama Library....which has over 3 million documents, and no one is allowed access to them, or oversight as to what Obama "Classified them as...Presidential or Personal"
Trump never even had time to go through most of the stuff packed and stored securely after leaving the Whitehouse, and unlike past Presidents, Vice Presidents, and even people never elected to the Presidency, or Vice Presidency....he did not have an Immediate Multi Million Dollar book deal that he was in a hurry to get published n order to justify the massive advance payments, or to support the usual "Post Term Business" of making many Massively Compensated speeches. Never before has an Archive "Librarian" ever made the claim that THEY and they alone must have 100% control, and physical possession of EVERYTHING a President created, saw, touched, received, sent, wore, or possessed while in office...including things brought to the office from prior life.
The Judge basically offered Smith a Choice...Either let the entire unvetted, no security clearance Jury see and decide whether each document Trump is charged with possessing is something he COULD lawfully posses, AND whether or not it is a "Dangerous to National Security"...If it was TOOOOO Dangerous for Trump to posses, because someone else "Might, Potentially, theoretically...even accidentally" see it. Smith has to INTENTIONALLY show it to the entire Jury in an open court, and enter them into the Court Records.
OR Have the Jury receive instructions word for word from the OFFICIAL Rules Governing classification/Declassification that actually state that NO AGENCY, Individual, or Court can alter, oversee, or define the Decisions of any President when it comes to Classification/Declassification...Personal vs Presidential documents and communications...and that NO President has ever before has been charged over such.
