The Death Warrant for American Ingenuity

Original Article

Last September, scores of patent-holders demonstrated in six cities across the U.S. wearing black t-shirts that said, "Homo sapiens inventoris: Endangered Species." These men and women of ingenuity were protesting America's decade of stolen dreams: the years since the passage of the America Invents Act (AIA) of 2011 and the establishment of the Patent Trial and Appeal Board (PTAB), which together have made it easy for big corporations to steal their ideas and profit from them with impunity. "We've had piracy for all the years I've been an inventor, but the AIA just put it on steroids, in the context that now you can get PTAB-ed and lose your rights

I have a patent on a small gun part, made and sold several thousand of them. Once they were selling reasonably well, for a small, niche market part, a larger company with a bigger name in the gun industry started selling duplicates. A letter from our attorney was replied with a basic "so sue me" letter. I inquired with the attorney, and he said "Write me a check for $25,000 and I'll start the process. Then expect to write two or three more of those, at least before we get any progress." Since we had made perhaps $8,000 or so on selling the parts, and there is no mass market for an upgrade part specific to one model of handgun only, we were done. And we were warned that if we contacted the large gun parts supply house that was selling the rip off parts, we would be sued immediately for interfering with their business. A consultation with the lawyer indicated that merely defending this meritless suit would cost more than we had made on the parts so far. I was tempted to contact the gun parts company anyway, but finally decided that losing $10-20K for the principle was just stupid. 'And the crooked SOBs at the other company made a habit of doing this, knowing that enforcing one's patent is hopelessly expensive except where the patent is worth millions. I heard that they had done this with a well known custom gunsmith, too, on another gun part. I knew him and called him. He had spend many thousands trying to stop them from stealing his design, no results other than losing more money. Small inventors have literally ZERO protection from a patent. Infringers have all the advantages. If someone attacks you and robs you with a gun, you can call the police and the government will arrest them and a government prosecutor and team of investigators will prosecute the theft at government expense. If you are robbed by a business of your patent rights - there is NO government enforcement of the patent laws, you must pay all the enforcement costs, so often these crimes go entirely unpunished. And with this new PTAB, it sounds like an even better way to steal patents from inventors. Patents are totally worthless these days. The criminal companies know that stealing your intellectual property is well worth doing.

Rule #1 You can patent a product but not an IDEA. If you have a patent idea but you are not producing it anybody who does produce it doesn't owe you a cent.

Dictator in chief Biden’s ‘extreme’ hypocrisy 4 replies

President Biden made history Thursday night with the first prime-time presidential speech with a backdrop inspired by the movie “V for Vendetta” and Nazi filmmaker Leni Riefenstahl. The harsh red atmospherics perfectly complemented Biden’s attempt to portray ex-President Donald Trump and Republicans as the Antichrist waiting to crucify American democracy. But the most important takeaway from the speech is the supreme hypocrisy of Biden’s Supreme Leader Democracy. Biden, speaking from Philadelphia, invoked the Declaration of Independence to sanctify his spiel. But he omitted quoting the line most relevant today from the author of that declaration.

The Democrat party’s pick for Secretary of Labor says CEOs are being victimized by a shortage of immigrant workers. Companies want to hire another 11 million people, Labor Secretary Marty Walsh told Fox News on September 2, adding: If those 11 million jobs had to be filled tomorrow, we certainly don’t have enough people in the United States to fill those jobs … the issue of workers has to be addressed and the only way [emphasis added] you can do it is through immigration. “When I talk to CEOs from companies all across America, they’re all in favor of immigration reform,” he said,

President Joe Biden delivered an address in front of Independence Hall in Philadelphia on Thursday night--that the White House described as remarks on the “battle for the soul of the nation”--in which Biden advocated for same-sex marriage and killing unborn babies through abortion. “MAGA forces are determined to take this country backwards—backwards to an America where there is no right to choose, no right to privacy, no right to contraception, no right to marry who you love,” Biden said.

President Joe Biden walked back his attacks on Donald Trump's MAGA supporters, saying on Friday he doesn't consider 'any Trump supporter a threat to the country.' 'I don't consider any Trump supporter a threat to the country,' the president said at the White House. It was a contrast to his remarks on Thursday night when, in a primetime address on the threat to democracy, he said Trump and his supporters were a threat to the republic. Republicans slammed Biden's speech as divisive while Trump said Biden was 'insane.' Biden toned down his tough talk on Friday, defending supporters of the former president.

“Clear and present danger” aren’t words any president should use lightly because that’s when the big guns used to come out against the First Amendment — and might again. Set aside for a few minutes the vaguely Nurembergesque optics of Thursday night’s historically divisive speech by Presidentish Joe Biden so we can concentrate on the content. “MAGA Republicans have made their choice. They embrace anger,” Biden angrily declared. “They thrive on chaos. They live not in the light of truth but in the shadow lies together.”

When candidate Joe Biden promised that if elected president he would unite the country, did he think he could do it alienating roughly half the population? Or did he mean he would unite the Democrats and independents against the “MAGA Republicans”? Thursday’s speech clearly indicates what he had in mind was the latter. Biden called “MAGA Republicans” a threat to democracy and doubled down on his rhetoric calling supporters of former President Donald trump “extremists.” WMAL talk show host Larry O’Connor threw the epithet Biden directed at Republicans back at the president.

Back in the 90s, at the height of the Monica Lewinsky scandal, the establishment media hammered home the proposition that the individual character of a chief executive didn’t matter. He could be a cheerful rogue and serial philanderer like Bill Clinton, but the Left insisted that was a private matter and that the only thing Americans should care about was that he was a competent and capable president (which he wasn’t, but that’s another story). In particular, the message focused on issues with the secure handling of sources and apparent errors made by CIA case officers that had led to the compromise of their sources. If true, this news ought to alarm every American, and drastic, corrective action ought to be taken immediately. CIA is taking a lot of hits these days. It should. Its leadership has gone dangerously astray and gotten involved in domestic political matters which should never be the province of a foreign intelligence organization.
